ABSTRAK Penelitian ini bertujuan untuk menganalisis efektivitas penerapan Restorative Justice dalam penyelesaian tindak pidana pencurian biasa di wilayah hukum Kepolisian Resor Kabupaten Sanggau dengan menggunakan teori efektivitas hukum menurut Soerjono Soekanto. Penelitian ini dilatarbelakangi oleh masih tingginya jumlah perkara pencurian biasa yang masuk ke kepolisian setiap tahunnya, sementara jumlah perkara yang diselesaikan melalui mekanisme Restorative Justice relatif sedikit, sehingga menimbulkan pertanyaan mengenai efektivitas penerapan mekanisme tersebut. Hasil penelitian menunjukkan bahwa penerapan Restorative Justice terhadap tindak pidana pencurian biasa di Polres Kabupaten Sanggau belum berjalan secara maksimal. Restorative Justice belum menjadi mekanisme penyelesaian perkara yang dominan dan masih bersifat alternatif. Rendahnya penerapan tersebut dipengaruhi oleh beberapa faktor, terutama faktor masyarakat dan faktor penegak hukum. Sebagian masyarakat, khususnya korban masih beranggapan bahwa keadilan hanya dapat terwujud apabila pelaku dijatuhi pidana penjara, sehingga menolak penyelesaian perkara melalui mekanisme perdamaian. Selain itu, belum adanya pelatihan khusus bagi penyidik dalam menangani perkara melalui Restorative Justice menyebabkan peran penyidik sebagai mediator belum optimal. ABSTRACT This study aims to analyze the effectiveness of the implementation of Restorative Justice in resolving ordinary theft criminal cases within the jurisdiction of the Sanggau Regency Police Resort, using the theory of legal effectiveness proposed by Soerjono Soekanto. This research is motivated by the persistently high number of ordinary theft cases reported to the police each year, while the number of cases resolved through the Restorative Justice mechanism remains relatively low, thus raising questions regarding the effectiveness of its implementation. The results of the study indicate that the application of Restorative Justice to ordinary theft cases at the Sanggau Regency Police Resort has not been carried out optimally. Restorative Justice has not yet become the dominant mechanism for case resolution and remains an alternative approach. The low level of implementation is influenced by several factors, particularly community factors and law enforcement factors. Some members of the community, especially victims still believe that justice can only be achieved if offenders are sentenced to imprisonment, thereby rejecting case settlement through peaceful mechanisms. In addition, the absence of specialized training for investigators in handling cases through Restorative Justice has resulted in the investigators’ role as mediators not being optimal.
