Abstract

Although bullying prevention has received increasing attention in educational research, limited empirical work has examined it through the integrated perspectives of educational authority, Islamic family law values, and multi-stakeholder governance. This study analyzes the social-structural manifestations of bullying, the role of educational authority in anti-bullying policy formulation and implementation, the institutionalization of Islamic family law values as a preventive strategy, and the dynamics of multi-stakeholder collaboration in bullying prevention governance at SMP Negeri 23 Kerinci, Jambi. Employing a qualitative case study design, the research involved 25 purposively selected participants, including school leaders, teachers, students, parents, and external stakeholders. Data were collected through semi-structured interviews, non-participant observations, and document analysis, and analyzed using interactive thematic analysis. The findings indicate that bullying is predominantly manifested in non-physical and relational forms embedded in normalized peer interactions and weakly supervised spaces. Educational authority is exercised largely through bureaucratic compliance and reactive responses, thereby limiting its preventive effectiveness. Islamic family law values, such as rahmah, amanah, and ukhuwah, are morally influential but remain informally practiced and insufficiently institutionalized within school governance structures. In addition, weak, procedural, and incident-based collaboration among schools, families, and local government actors constrains shared accountability and undermines sustainable prevention efforts. The study concludes that bullying prevention constitutes a systemic governance challenge that requires the integration of proactive educational authority, the formal institutionalization of moral-legal values, and sustained multi-stakeholder synergy. These findings contribute to value-based and institutional approaches to bullying prevention while offering practical implications for policy development and collaborative school governance.

Abstract

This study examines the social meaning and legal interaction of dowry differentiation within Muslim communities in Tanjung Pauh, focusing on the relationship between customary law and Islamic law. While previous studies on dowry in Indonesia have largely emphasized normative or economic aspects, limited attention has been given to how legal pluralism operates in everyday social practices, particularly when customary norms introduce distinctions not explicitly regulated in Islamic jurisprudence. This research adopts an empirical legal approach with a qualitative descriptive design. Data were collected through semi-structured interviews with customary leaders, religious figures, village authorities, and community members, complemented by observation and document analysis. The findings indicate that dowry determination is governed by a collective and institutionalized customary system, in which virgins receive one gram of gold and widows receive half a gram. This differentiation is consistently applied and widely accepted as a cultural symbol reflecting marital experience rather than as a form of social inequality. From the perspective of Islamic law, the practice is considered permissible as it upholds the principles of mutual consent, fairness, and the absence of coercion. This study demonstrates that the interaction between customary law and Islamic law results in a form of normative convergence, where local traditions are accommodated within Islamic legal values. It contributes to the discourse on legal pluralism by highlighting that culturally embedded practices can function harmoniously without undermining gender dignity. Practically, the study provides insight into how community-based norms shape the implementation of Islamic family law in diverse social contexts.

Abstract

Studi ini meneliti politik hukum Islam dalam legislasi hukum keluarga Islam di Indonesia, khususnya terkait dengan Undang-Undang Perkawinan. Penelitian ini didasarkan pada asumsi bahwa perumusan hukum keluarga di Indonesia bukan hanya proses yuridis, tetapi juga negosiasi politik yang melibatkan nilai-nilai agama, otoritas negara, dan perubahan sosial. Tujuan studi ini adalah untuk menganalisis bagaimana prinsip-prinsip hukum Islam diakomodasi, ditransformasikan, dan diinstitusionalisasikan dalam kerangka hukum nasional melalui legislasi perkawinan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan hukum perundang-undangan, konseptual, dan historis. Materi hukum terdiri dari sumber primer, termasuk undang-undang dan peraturan terkait perkawinan, dan sumber sekunder berupa karya ilmiah tentang hukum Islam, politik hukum, dan reformasi hukum keluarga. Data dianalisis secara kualitatif melalui interpretasi hukum dan pemeriksaan sistematis terhadap perkembangan legislatif. Temuan menunjukkan bahwa Undang-Undang Perkawinan mencerminkan kompromi antara ajaran normatif Islam, tradisi hukum yang plural, dan kepentingan negara dalam penyatuan hukum. Akomodasi ini menunjukkan bahwa politik hukum Islam di Indonesia beroperasi melalui model yang moderat dan adaptif, di mana nilai-nilai Islam secara substansial diintegrasikan ke dalam hukum nasional tanpa sepenuhnya mengubah negara menjadi sistem hukum agama yang formalistik. Studi ini lebih lanjut mengungkapkan bahwa legislasi hukum keluarga Islam dibentuk oleh kontestasi ideologis, tekanan sosio-politik, dan kebutuhan untuk menanggapi isu-isu kontemporer seperti keadilan gender, kepastian hukum, dan ketertiban sosial. Disimpulkan bahwa politik hukum Islam dalam legislasi perkawinan di Indonesia mewakili proses harmonisasi yang dinamis antara prinsip-prinsip syariah, nilai-nilai konstitusional, dan tujuan yang lebih luas dari hukum nasional.

Materi hukum terdiri dari sumber primer, termasuk undang-undang dan peraturan terkait perkawinan, dan sumber sekunder berupa karya ilmiah tentang hukum Islam, politik hukum, dan reformasi hukum keluarga. Data dianalisis secara kualitatif melalui interpretasi hukum dan pemeriksaan sistematis terhadap perkembangan legislatif. Temuan menunjukkan bahwa Undang-Undang Perkawinan mencerminkan kompromi antara ajaran normatif Islam, tradisi hukum yang plural, dan kepentingan negara dalam penyatuan hukum. Akomodasi ini menunjukkan bahwa politik hukum Islam di Indonesia beroperasi melalui model yang moderat dan adaptif, di mana nilai-nilai Islam secara substansial diintegrasikan ke dalam hukum nasional tanpa sepenuhnya mengubah negara menjadi sistem hukum agama yang formalistik. Studi ini lebih lanjut mengungkapkan bahwa legislasi hukum keluarga Islam dibentuk oleh kontestasi ideologis, tekanan sosio-politik, dan kebutuhan untuk menanggapi isu-isu kontemporer seperti keadilan gender, kepastian hukum, dan ketertiban sosial. Disimpulkan bahwa politik hukum Islam dalam legislasi perkawinan di Indonesia mewakili proses harmonisasi yang dinamis antara prinsip-prinsip syariah, nilai-nilai konstitusional, dan tujuan yang lebih luas dari hukum nasional.
