Abstract

The Qur'an introduces Islam as ad din, therefore, Islam is not just a "religion" in the narrow sense, but covers all aspects of human life. in ad-din al Islam, humans are required to menggayutkan all its activities, either born or spiritual to the supreme absolute reality, that is God Almighty. Being a Muslim, meaning, expression forever subservient and obedient to Allh SWT, devote yourself to Him.The teachings of Islam, he said, ordered to consider the interests of minorities, recognize their rights, especially all the rights included in the circle of human rights. in the concept of this country as the reference is the Qur'an and Sunnah. Thus requiring an ijtihad to review it.Countries in the Islamic perspective, if explored further in fact no concept of the state in the Qur'an Q.S. Ali Imran (3): 140, Q.S. Al-Hashr (59): 7, Q.S. Al Bagarah (2): 213, Q.S. Shura (42): 38, Q.S. An Nisa (4), while the Government of the Prophet with a combination of the people of the Ansar and muhajrin an early milestone of unity and brotherhood, as well as other people are tribes that are in the Medina area in conducting their activities as social beings with their charter Medina. This union covers all aspects of life.

Abstract

Indonesia is a country inhabited by various tribes, races and religions. A long history of Indonesian nation with various ethnics make kind of multicultural religious which is brought lives phenomenon. Islam as the majority religion in Indonesia provides significant meaning in appreciating benefit and respecting the diversity religious of people in Indonesia. The concept of rahmatan lil Alamin is seeded according to the context in Indonesia. Thus, an inclusive understanding by collocated Islam as a progressive religion nowadays becomes a necessity to solve problems and the importance of a complex human beneficial. On the other hand, the necessity of multicultural awarenness of religious in Indonesia made this country as barometer of other country in appreciating a fair law to all the citizens, but when the diversity of this nation does not respect other religions, it will bother the religious‟ stability and national life in the country. Islam has given point of views in national life and taught how to respect other people who has different belief. So, people who has different belief should do the same to appreciate Islam. The history of the world has taught us about the importance of appreciate people and respect the law for the nation, then the nation will be a peaceful and prosperous country.

Abstract

Pepper is one of the leading commodities in the plantation sub-sector and has great potential for Indonesia's economic growth. Indonesia is known as one of the world's main producers of pepper, especially black pepper which comes from Lampung Province and white pepper which comes from the Bangka Belitung Islands Province. Nationally, the Bangka Belitung Islands province is the province with the largest pepper income in Indonesia. Over time, efforts have emerged from the government to overcome the problem of fluctuating pepper prices resulting in low prices at the farmer level by implementing the Warehouse Receipt System (SRG). This research tries to examine how the management of pepper warehouse receipts in Bangka Belitung is related to WRS which is currently developing. The objects of this research are warehouse receipts. The results of this research indicate that the management of the Warehouse Receipt System in Bangka Belitung in general has not been implemented optimally, this can be seen from the public's lack of understanding about warehouse receipts, as well as the small number of pepper farming communities who use warehouse receipts as temporary storage, as for the obstacles faced by warehouse receipt managers, including the lack of information and outreach to pepper farmers about warehouse receipts themselves. Banking access for pepper farming communities in Bangka Belitung is quite good, because in its implementation sharia banks in Bangka Belitung can provide financing using warehouse receipts as collateral.

Abstract

Artikel ini bertujuan menjelaskan sejarah sosial perkembangan hukum gadai dan gadai syariah di Indonesia. Gadai merupakan bagian dari aktifitas ekonomi yang telah berlangsung lama. Terdapat tiga corak hukum yang mengatur praktik gadai, yaitu: hukum positif, hukum adat dan hukum Islam. Ketiga jenis hukum tersebut terus berkembang mengikuti dinamika sosial masyarakat, sehingga ikut mempengaruhi perkembangan praktik gadai sebagai instrument keuangan alternatif yang banyak dimanfaatkan oleh masyarakat.

Abstract

This article examines the bureaucratization dynamics of sharia economic law through the role of the National Committee for Islamic Economy and Finance (KNEKS). Employing a qualitative research design with an institutional–legal analysis approach, the study draws on documentary analysis, official policy documents, and in-depth interviews with key informants. The findings demonstrate that, in contrast to the Indonesian Council of Ulama (MUI), which functions as a quasi-legislative body producing normative legal instruments, KNEKS operates primarily as a legal structure that coordinates and harmonizes cross-institutional policies within the sharia economic governance framework. However, the study also reveals a persistent gap between legal structure and legal culture, as KNEKS’s institutional positioning has yet to significantly enhance public legal awareness and literacy in sharia economic law. This article contributes to the literature on Islamic legal governance by offering an institutional perspective on bureaucratization processes and highlighting the need for policy formulations that integrate bureaucratic mechanisms with community-based social capital to strengthen legal culture in sharia economic development
