Abstract

An official order is an order given by someone who has power and position in an institution or institution. A valid official order is an official order given by someone who has the authority and the order is still in the realm of his work. The article governing official orders is contained in Article 51 of the Criminal Code. Obstruction of justice is an act that harms many parties, therefore anyone involved in obstruction of justice deserves to be punished according to applicable law. The research method used in writing this thesis is normative, namely examining laws and examining scientific papers that are in accordance with the problems that are the topic of making a thesis. The result of this research is that a person who commits an act of obstruction of justice in an official order can be given a penalty according to the provisions if with full awareness knows that the act is an act that has elements of a criminal offense and cannot be said to be obstruction of justice if the person concerned does not know at all that the order contains elements of a criminal offense.

Abstract

Penelitian ini membahas permasalahan kritis tentang tumpang tindih regulasi Tanggung Jawab Serta peran dari komisi yudisial dalam sistem hukum Indonesia, Komisi Yudisial memiliki peran strategis dalam pengawasan dan pembinaan etika hakim untuk menjaga integritas dan kepercayaan publik terhadap lembaga peradilan. Penelitian ini bertujuan untuk menganalisis peran Komisi Yudisial dalam memastikan penerapan etika profesi hakim di Pengadilan Negeri Kolaka. Metodologi yang digunakan adalah pendekatan kualitatif dengan pengumpulan data melalui wawancara mendalam, dan telaah dokumen terkait. Hasil penelitian menunjukkan bahwa pengawasan Komisi Yudisial dilakukan melalui pemantauan sidang, investigasi dugaan pelanggaran etika, dan pemberian rekomendasi sanksi kepada hakim yang melanggar kode etik. Selain itu, pembinaan etika dilaksanakan melalui pelatihan dan penyuluhan tentang integritas profesi. Tantangan utama yang dihadapi adalah adanya tekanan dari pihak eksternal yang dapat memengaruhi independensi hakim serta keterbatasan sumber daya dalam proses pengawasan.

Abstract

Ikatan Notaris Indonesia (INI) sebagai perkumpulan organisasi bagi para notaris mempunyai peranan yang sangat penting dalampenegakkan kode etik. Dewan Kehormatan merupakan alat perlengkapan perkumpulan yang berwenang melakukan pemeriksaan atas pelanggaran terhadap kode etik dan menjatuhkan sanksi kepada pelanggarnya sesuai dengan kewenangannya. Notaris adalah seorang profesional di bidang hukum yang berperan penting dalam menciptakan kepastian hukum dan membantu masyarakat dalam berbagai urusan hukum keperdataan. Pelaksanaan sanksi yang dijatuhkan oleh Dewan Kehormatan Ikatan Notaris lndonesia sebagai organisasi profesi terhadap Notaris yang melanggar kode etik, adalah: teguran, peringatan dan pemberhentian atau pemecatan dari keanggotaan perkumpulan. Sanksi tersebut hanya berdampak terhadap notaris sebagai anggota perkumpulan dan tidak berdampak terhadap notaris sebagai Pejabat Umum. Untuk menjadi penyelenggaraa profesi hukum yang baik dalam menjalankan tugas profesinya dalam menegakkan hukum dibutuhkan praktisi yang memiliki kualifikasi sikap, sikap kemanusiaan, sikap keadilan, mampu melihat dan menempatkan nilai-nilai obyektif dalam suatu perkara yang ditangani, sikap jujur, serta kecakapan teknis dan kematangan etis.

Abstract

The police code of ethics is regulated in the Chief of Police Regulation (Perkap) No. 14 of 2011, namely Personality Ethics; is the moral attitude of Polri members towards their profession based on the call of worship as religious people, State Ethics; is the moral attitude of Polri members who uphold the ideological and constitutional foundations of the Republic of Indonesia, namely Pancasila and the 1945 Constitution of the Republic of Indonesia and Institutional Ethics; is the moral attitude of Polri members towards the institution which is a place of devotion and should be upheld as a physical and spiritual bond of all Bhayangkara people with all their dignity and honor. But in reality, many police officers commit violations, especially serious violations, such as domestic violence, LGBT, sexual harassment, violence and other criminal acts. Therefore, this encourages the author to analyzethe sanctions for violators of the serious code of ethics in the Police. The research method used is empirical normative, namely juxtaposing the rules with the facts in the field, and the normative juridical method, namely the library approach method by studying statutory books and other legal scientific works. This legal research found that the application of sanctions for serious violators of the code of ethics must go through procedures that have been determined in the code of ethics regulations.

Abstract

Corporations play a significant role in the economic development of society, but they not only have positive impacts, but also cause negative, deviant impacts. where the characteristics and movements are different from conventional crimes in general. Unclear regulations on corporate criminal liability are a major obstacle in eradicating criminal acts committed by corporations. Although corporations have been designated as legal subjects. This research focuses on the study of the regulation of corporate criminal liability based on Law Number 1 of 2023 and to determine the concept of criminalization of corporations as perpetrators of criminal acts. This research uses a normative research method, which focuses on collection and analysis with a statutory approach, a case approach, and a conceptual approach. The results of the study concluded that in Law Number 1 of 2023 concerning the Criminal Code, in addition to two forms of error (intentional and negligence), it also regulates unlawful acts that can be held criminally accountable to corporations and shareholders where each article formulation requires that every act and the consequences of the act must be intended by the perpetrator to be held criminally accountable. The imposition of corporate criminal liability is regulated in Articles 45-50 of Law Number 1 of 2023 concerning the Criminal Code, strengthening the teaching/doctrine of piercing the corporate veil in imposing criminal liability on shareholders who commit crimes.

Abstract

This study aims to analyze the implementation of professional ethics in the Kolaka District Attorney's Office and its impact on the integrity and public trust in law enforcement institutions. Using an empirical legal approach, data were collected through interviews with prosecutors, direct observation, and documentation studies related to the code of ethics regulated in the Regulation of the Attorney General of the Republic of Indonesia Number PER-014/A/JA/11/2012. The results of the study indicate that despite consistent efforts to implement the code of ethics, violations such as abuse of authority and non-compliance with ethical norms are still found. These violations have a negative impact on the image of the prosecutor's office and reduce public trust in the justice system. Therefore, it is necessary to increase ethics training, strict supervision, and feedback mechanisms from the public to ensure integrity in the implementation of prosecutors' duties in order to realize justice.

Abstract

The police are agencies that carry out and maintain order, security, and law enforcement throughout Indonesia. The police institution has a crucial role in carrying out its duties. However, in reality, there are still many members of the police who do inappropriate things and violate the provisions stipulated in the Police Professional Code of Ethics as stipulated in Law No. 2 of 2002 concerning the Police Code of Ethics. This study aims to analyze law enforcement against police members involved in bribery practices in fines, as well as identify the obstacles faced in the law enforcement process. Effective law enforcement is essential to maintain the integrity of police institutions and ensure justice for the community. However, the practice of bribery involving police members often hampered the law enforcement function itself. Through a qualitative approach, this study found that factors such as entrenched culture of corruption, lack of internal oversight, and public fear of reporting, became significant obstacles in cracking down on police members who received bribes. In addition, complicated legal processes and support from certain parties in the power structure have made the situation worse. This study recommends the need for reforms in the surveillance system, ethics education for police members, and increased protection for whistleblowers to create a more transparent and accountable law enforcement environment.

Abstract

The arrest procedure has been regulated in the Criminal Procedure Code. However, in practice, it is possible that in the arrest process there may be wrongful arrests. In legal terms, wrongful arrests made by police investigators are called errors in persona. The purpose of this study is to determine the accountability of police investigators when making wrongful arrests based on the law and legal remedies carried out by suspects in the event of an error in persona. In this study, the author used a normative research method which is research conducted by literature study or document study. The data analysis technique used is a qualitative normative analysis, namely by interpreting or drawing conclusions about the legal materials that have been processed. The results of the study show that the responsibility of police investigators when making wrongful arrests based on the law can be in the form of civil liability, criminal liability, and ethical and administrative liability. The legal remedies taken by the suspect in the event of an error in persona are in the form of pretrial legal remedies which are judicial legal remedies, and the victim of wrongful arrest can also take non-judicial legal remedies (out-of-court settlement) in the form of a complaint to the National Human Rights Commission (Komnas HAM), or a complaint to the nearest Police Service Center (SPK).

Abstract

This research aims to find and analyze violations of the code of ethics for the National Police public relations profession (case study Ferdi Sambo). The method used in this research is a qualitative descriptive method with data collection carried out by researchers through library research (library study). The data analysis technique uses a data analysis approach, namely data collection, data reduction, data display, conclusion drawing. The results of this research show that the violation of the professional code of ethics in the Ferdi Sambo case study has tarnished the good name of the National Police institution, damaged the image and reputation of the National Police. National Police Public Relations is able to resolve problems quickly by increasing the role of National Police Public Relations to expert prieciber, problem solving communication facilitator, technician communication facilitator. Analysis of this case provides a lesson for the public that when carrying out a profession one must be professional and not involve emotional feelings whose impact is not only detrimental to oneself but also detrimental to the institution and the public.

Abstract

The application of ethics in law enforcement is an important area of study, especially as police officers navigate the complexities of their role in society. This paper examines the relationship between legal obligations and moral responsibilities in police work, with a focus on how ethical considerations shape police practice. Using a mixed-methods approach, this research integrates qualitative interviews with law enforcement officials and quantitative surveys to gather insights into ethical challenges in daily operations. Findings suggest that officers often face dilemmas when legal mandates conflict with ethical imperatives, leading to tensions between law enforcement and justice. Key areas of concern include use of force, racial profiling, and transparency of police behavior. This study highlights the importance of ethics training programs that equip officers to make decisions under pressure. The report also emphasizes the role of leadership in fostering a culture of integrity in police departments. This research discusses the implications of ethical policies for public relations, showing that compliance with ethical standards can increase public trust. By comparing successful case studies with examples of ethical violations, this paper illustrates the consequences of neglecting ethical responsibilities. Ultimately, this research advocates a comprehensive framework that integrates ethical considerations into all aspects of police work, ensuring a balance between legal duties and commitment to society.
