Abstract

ABSTRAKMeskipun Indonesia dan Malaysia merupakan dua bangsa serumpun, namun hingga kinimasih sering terjadi permasalahan antara kedua negara. Salah satu permasalahan yang hinggakini belum terselesaikan adalah terkait dengan sengketa perbatasandarat, antara kedua negaramulai dari perbatasan yang ada di Provinsi Kalimantan Barat hingga wilayah ProvinsiKalimantan Timur.Seringmuncul masalah terkait isu pergeseran dan pencabutan patok batassecara sepihak yang diklaim dilakukan oleh pihak lawan. Hal ini tidak terlepas dari dasar hukumdijadikan argumen dari masing-masing negara baik Indonesia dan Malaysia, perbedaanpendapat mengenai batas Negara oleh Indonesia dan Malaysia sering kali tidak mencapai titiktemu. Terakhir 2018 lalu Indonesia dan Malaysia telah melakukan sedikitnya sembilanpertemuan teknik membahas demarkasi penyelesaian sengketa batas kedua negara. Penelitianmencoba untuk menganalisis prospek penyelesaian masalah tapal batas kedua Negarakhususnya di sector barat. Dari hasil penelitian menggambarkan prospek penyelesaian masalahtapal batas kedua Negara, suda mulai berjalan efektif. Tahap-tahap di dalam penyelesaian yangefektif yaitu negosiasi berdasarkan MoU yang beroreantasi pada traktat London.Kata Kunci :Prospek Penyelesaian, Sengketa Tapal Batas WilayahPROSPECT OF DISPUTE SETTLEMENT OF THE INDONESIAN BATTLE OF MALAYSIA INTHE WEST SECTOR AREA KALIMANTAN-SARAWAKABSTRACTAlthough Indonesia and Malaysia are two allied nations, there are still frequent problemsbetween the two countries. One of the problems that has yet to be resolved is related to land borderdisputes, between the two countries starting from the borders in West Kalimantan Province to EastKalimantan Province. Problems often arise related to the issue of unilaterally shifting andremoving boundaries claimed by the opposing party. This is inseparable from the legal basis usedas an argument from each country both Indonesia and Malaysia, differences of opinion regardingthe boundaries of the State by Indonesia and Malaysia often do not reach common ground. Last2018, Indonesia and Malaysia had held at least nine technical meetings discussing the demarcationof the dispute resolution of the two countries. This research tries to analyze the prospect of solvingthe problem of the boundaries of the two countries, especially the western sector. The results of thestudy illustrate the prospect of resolving the border issue between the two countries, which hasbegun to run effectively. The stages, in an effective settlement, are negotiations based on an MOUthat orientates in the London treaty.Keywords: Settlement Prospect, Territorial Border Dispute
