IMPLEMENTASI MODEL PARATE EXECUTIE ATAS JAMINAN FIDUSIA: (Uji Model Eksekusi Jaminan Fidusia)

This research is purposed to measure the Fiduciary Parate Execution Model (FPEM) in solving concrete events based on analogy. The problems include: 1) the implementation of FPEM; 2) the obstacles in testing of FPEM; and 3) the forming of regulation as a construction to overcome the obstacles of FPEM. The method of this research is normative legal approach armed with system of self explanatory which a norm is a rule or an authoritative standard or what law ought to be. The result of FPEM is a recommendation in which contains the prescriptive value i.e the forming of regulation on FPEM. Keywords: Parate Execution, Fiduciary Security, Self-Explanatory.  Penelitian ini bertujuan untuk mengukur pelaksanaan Model Parate Eksekusi Jaminan Fidusia (MPEJF) dalam memecahkan peristiwa konkret berdasarkan analogi. Permasalahannya meliputi: 1) Implementasi MPEJF; 2) Kendala pengujian MPEJF; dan 3) Pembentukan peraturan sebagai konstruksi ideal untuk mengatasi kendala MPEJF. Metode penelitian yang digunakan adalah metode pendekatan normatif yang didukung oleh sistem“self-explanatory” dimana suatu norma adalah suatu aturan atau ukuran bersifat mengikat atau hukum yang seharusnya. Hasil dari MPEJF bersifat rekomendasi atau preskriptif yaitu bentuk rancangan regulasi tentang parate EJF.   Kata Kunci : Parate Eksekusi, Jaminan Fidusia, Self-Explanatory.
