<![CDATA[ABSTRAK Corporate Social Responsibilty (CSR) merupakan suatu kegiatan perusahaan dimana perusahaan memiliki tanggung jawab untuk membaktikan dirinya demi mensejahterakan masyarakat dan lingkungannya. Perkembangan cara pandang terhadap corporate social responsibility semakin kuat dari waktu kewaktu dimana konsep bentuk perbuatan yang bersifat sukarela (voluntary) telah bergeser secara perlahan-lahan menuju bentuk perbuatan atas dasar kewajiban (obligation) baik itu berbentuk kewajiban moral maupun kewajiban yuridis. Yang menjadi permasalahan dalam Tesis ini adalah Mengapa kesenjangan sosial masyarakat yang berada di area kerja PT. SDK I Batu Buil Masih tinggi?, Bagaimana pelaksanaan corporate social responsibility yang di lakukan oleh PT. SDK I Batu Buil kepada masyarakat Desa Batu Buil?,Apakah kendala yang dihadapi oleh PT. SDK I Batu Buil dalam melaksanakan Program corporate social responsibility dalam tanggung jawab sosial terhadap masyarakat?,Bagaimana upaya pemerintah daerah mondorong pelaksanaan corporate social responsibility dapat memberikan dampak nyata bagi kesejahteraan masyarakat?Metode penelitian yang digunakan dalam menyusun Tesis ini adalah penilitan Hukum Empiris yaitu penelitian obyek kajian penelitian ini mengenai fakta-fakta empiris (kenyataan) dari interaksi antara hukum dan masyarakat. Serta menggunakan pendekatan Deskriptif Analisis, yaitu meneliti dan menganalisis keadaan subyek dan obyek penelitian dengan menggambarkan keadaan yang sebenarnya pada saat penelitan dilakukan. Tanggungjawab perusahaan bersifat relatif tergantung dari dasar dilakukannya corporate social responsibility tersebut, pelaksanaan corporate social responsibility berdasarkan kesukarelaan tentu tidak memiliki kosekuensi apapun, namun apabila CSR dilakukan berdasarkan kesadaran akan kewajiban maka perseroan tentu memiliki batasan tanggung jawab yang jelas terlebih lagi jika kewajiban tersebut kewajiban yuridis. Hambatan yang dihadapi PT. SDK I Batu Buil dalam pelaksanaan bentuk-bentuk corporate social responsibility adalah kekurangan anggaran, Distribusi kegiatan serta penentuan target, Kurangnya Tenaga Terampil di Bidang Kegiatan Sosial. The development of perspective on corporate social responsibility is getting stronger from time to time where the concept of voluntary forms of action has shifted slowly towards the form of action on the basis of obligation (obligation) either in the form of moral obligations or juridical obligations. The problem in this thesis is why the social gap in the community in the work area of PT. And using the Descriptive Analysis approach, which examines and analyzes the state of the subject and object of research by describing the actual situation when the research was conducted.Corporate responsibility is relatively dependent on the basis of corporate social responsibility, the implementation of corporate social responsibility based on volunteerism certainly does not have any consequences, but if CSR is carried out based on awareness of obligations, the company certainly has a clear limitation of liability even more so if the obligation is juridical.
