Abstract

AbstractThis article discusses taqlid and talfiq in the conception of Islamic Law. With the aim of knowing taqlid and talfiq in the conception of Islamic law and the extent to which both affect people's understanding of Islam. This article uses qualitative research based on the library (library research) with a descriptive approach to qualitative and technical descriptive analysis and content analysis. The results of this study indicate that taqlid and talfiq are phenomena of understanding religious diversity in Islamic societies. Taqlid arises when someone is unable and does not want to get Islamic laws directly from the source and is more happy and satisfied to refer to the thought products of the ulama especially the school of scholars. While talfiq is a logical consequence of the existence of taqlid.Keywords: Taqlid, Talfiq, Islamic Law, Fuqaha, School AbstrakArtikel ini membahas tentang taqlid dan talfiq dalam konsepsi Hukum Islam. Dengan tujuan untuk mengetahui taqlid dan talfiq dalam konsepsi hukum Islam dan sejauh mana keduanya memengaruhi pemahaman masyarakat terhadap Islam. Artikel ini menggunakan penelitian kualitatif berbasis kepustakaan (library research) dengan pendekatan deskriptif kualitatif dan teknis analisis deskriptif dan content analysis. Hasil penelitian ini memperlihatkan bahwa taqlid dan talfiq merupakan fenomena pemahaman keberagamaan dalam masyarakat Islam. Taqlid muncul ketika seseorang tidak mampu dan tidak mau mendapatkan hukum-hukum Islam secara langsung dari sumbernya dan lebih senang dan puas merujuk kepada produk pemikiran para ulama khususnya ulama mazhab. Sedangkan talfiq merupakan konsekuensi logis dari keberadaan taqlid.Kata Kunci: Taqlid, Talfiq, Hukum Islam, Fuqaha, Mazhab
