Abstract

Wakaf merupakan ajaran Islam yang menyangkut kehidupan masyarakat. Harta benda wakaf dapat digunakanuntuk pembiayaan dakwah, pendidikan, kesehatan, pembangunan sarana dan prasarana ibadah, sosial,pemberdayaan ekonomi dan kesejahteraan lainnya. Berbagai aturan dibuat oleh pemerintah Indonesia untukmelindungi harta benda wakaf secara hukum. Harta benda wakaf dapat terlindungi secara hukum apabiladiaministrasikan. Tujuan penelitian ini adalah; 1) Mendeskripsikan harta benda wakaf yang ada di KecamatanWiradesa Kabupaten Pekalongan. 2) Mendeskripsikan kondisi pengadministrasian harta benda wakaf sebagai upayaperlindungan hukum terhadap aset publik di Kecamatan Wiradesa Kabupaten Pekalongan. Jenis penelitian ini feildresearch dengan pendekatan sosiologis. Pengumpulan data melalui observasi dan wawancara. Analisis datamenggunakan metode induksi-itepretasi-konseptualisasi. Hasil penelitian menunjukkan kesadaran untukmengadministrasikan harta benda wakaf masih rendah. Harta benda wakaf umumnya berupa tanah dan bangunan,mayoritas belum tersertifikasi. Penggunaan wakaf umumnya untuk masjid, langgar, dan lembaga pendidikan. Potensipenyimpangan sangat besar seperti beralih kepemilikan menjadi aset pribadi.Key word: pengadministrasian, harta benda wakaf, perlindungan hukum, aset publik.

Abstract

The development of national law is still in process. The national law in the futuremust provide certainty of the protection of human rights. The flow of globalizationhas given every citizen broad access to understand the value and concept of humanrights protection. The problems in this research are: How is the concept of humanrights in Indonesia? 2) How are the human rights violations occurring in Indonesiaand the settlement efforts? 3) How is the urgency of the development of nationallaw that is oriented towards the protection of human rights in the future? Thisresearch uses normative approach. The research data used is secondary data in theform of library materials. The analysis used the induction-interpretationconceptualization.The results of this study show: human rights are a fundamentalright. Every human being has a degree, dignity and equal rights. Many grosshuman rights violations in Indonesia. Human Rights Court ever held in Indonesiayet, but considered to be blunt. Development of national laws on the protection ofhuman rights should be oriented in line with the global demands that each countrymust uphold human rights.Keywords : Development of national law, orientation, human rights.

Abstract

Abstrak  Penelitian ini membahas etika bisnis Islam sebagai solusi praktis dalam lingkup e-commerce. Tujuan penelitian untuk menjawab bagaimana solusi yang ditawarkan etika bisnis terhadap ruang lingkup bisnis e-commerce. Penelitian ini menggunakan pendekatan kepustakaan (library research) dengan cara mendeskripsikan dan menganalisis objek penelitian yang berkaitan dengan topik, kemudian dianalisis dan terakhir ditarik kesimpulan serta dideskripsikan dalam bentuk laporan tertulis. Hasil penelitian menunjukkan bahwa Islam sebagai agama rahmatan lil alamen telah memberikan tuntunan kepada setiap manusia, khususnya kepada seluruh umat Islam, bahwa dalam aktivitas bisnis terdapat etika Islam yang melekat di dalamnya, termasuk dalam lingkup e-commerce. Etika tersebut dimaksudkan agar kegiatan bisnis tidak semata-mata menghasilkan keuntungan materil tetapi lebih dari itu memberikan manfaat lebih sehingga tercapai baik di dunia maupun di akhirat. Oleh karena itu, Islam sangat mengatur berbagai kegiatan bisnis seperti produksi, konsumsi, perdagangan, persaingan dalam bisnis hingga memasarkan suatu produk kepada konsumen. Semua etika ini sangat penting dalam kegiatan bisnis e-commerce.  Abstract This article discusses Islamic business ethics as a practical solution in the scope of e-commerce. With the objective of the research to answer how the solutions offered by business ethics to the scope of the e-commerce business. This study used a literature approach by describing and analyzing research objects, later analyzed and finally drawing conclusions. The results of this study show that Islam as rahmatanlilalamien religion has provided guidance to every human being, especially to all Muslims, that in business activities there is an Islamic ethic inherent in it, including in the scope of e-commerce. The ethics are intended that business activities do not solely produce material benefits but more than that it gives more benefits so that it is achieved in both the world and the hereafter. Therefore, Islam really regulates various business activities such as production, consumption, trading, competing in business to market a product to consumers.

Abstract

Constitutional Court Decision No. 46/PUU-VIII/2010 granted the petition Machica Mochtar, who is married with Moerdiono the Islamic religion in accordance, but not recorded. If the marriage was born a boy named Mohammed Iqbal Ramadan. After the decision of the Court, the status of illegitimate children has a civil relationship with his father and his father’s family. Child outside  marriage  include  children born of the marriage legitimate religion, but not recorded, and the children born from adultery. According to Islamic law, the Constitutional Court’s decision is appropriate when applied to the child of a valid marriage according to religious but not registered. Meanwhile, when applied to children outside marriage, adultery result, the Court’s decision is contrary to Islamic law.

Abstract

Purpose: This article discusses about the other side of al-Farabi, an Islamic economic thinker. With the aim that an open paradigm of thinking new in seeing al-Farabi, not only political experts and famous philosophers, but also as a reliable Islamic economic thinker.Design/Method/Approach: This article uses library-based qualitative research (qualitative research) with a qualitative descriptive approach and technical descriptive analysis and content analysis.Finding: This study was able to identify that al-Farabi was truly an Islamic economic thinker. Al-Farabi's Islamic economic thinking can be seen in his works such as the Book of Ara 'Ahl al-Madinah al-Fadilah, Kitab al-Siyasat al-Madaniyah and the Tahsil al-Sa'adah Book. Al-Farabi was one of the economic thinkers who emphasized his economic thinking on the concept of man as homo Islamicus who had an advantage in the field of reason compared to other beings (al-hayawan al-nathiq) where one of his goals was to become a perfect society (al- kalimah) and happy by doing noble actions, virtues and virtues. However, in its journey, the existence of the community formed a state that was in the form of a main state (al-Madinah al-Fadilah), a foolish state (al-madinah al-Jahilah), a fasiq state (al-madinah al-Fasiqah), a perverse country (al -madinah al-Dhallah), and a changing state (al-madinah al-Mutabaddilah). The ideal country that can manifest human happiness is the main country (al-Madinah al-Fadilah).Originality/Novelty: This research contributes to filling the 'emptiness' of Islamic economic theory, which comes from Al-Farabi's thoughts and works. This study did not become a 'copy' which informed the other side of Al-Farabi as a philosopher. But he also offers economic thinking, especially in relation to the human concept and welfare state.

Abstract

Abstract. In the financial sectors, fraud has become a world phenomenon, ranging from fraudulent financial reports, assets misappropriation and corruption. These three types of fraud are practices carried out deliberately against the law which harm many parties. This study aims to analyze fraudulent financial reporting, where the presentation of misstatements is presented to mislead financial reports. These are against the ethical perspective of Islamic law as stated in the Quran and Hadith. This research uses secondary data based on the principles of sharia accounting concepts and Islamic ethics. The analytical method used is a qualitative description method with literary and normative approaches by examining fraudulent financial reporting from the perspective of Islamic law. The results of this study strengthen the theory of fraud pentagon with the symptoms and red flags of fraud, namely pressure, opportunity, rationalization, competence, and arrogance of the perpetrators of fraud. The Quran as well as the hadith emphasize the values of honesty, justice, truth, responsibility, and belief in reporting. This research also overlooks the weak ethics of the accounting profession and also the value of religiosity held by weak accountants from the perspectives of Islam.Keywords: Accounting Fraud, Fraudulent Financial Reporting, Fraud Pentagon Theory, Islamic Legal Ethics Abstrak. Pada sektor keuangan, fraud (kecurangan) menjadi salah satu fenomena global, dengan kasus kecurangan laporan keuangan, penyelewengan aset dan korupsi. Ketiga bentuk kecurangan tersebut merupakan praktek yang dilakukan secara sengaja melawan hukum dan merugikan banyak pihak. Penelitian ini bertujuan untuk menganalisis kecurangan pelaporan keuangan, dimana informasi yang disajikan dalam laporan adalah hal yang tidak sesuai dengan kenyataan. Hal ini bertentangan dengan etika hukum Islam dalam Al-Qur'an dan Hadits. Penelitian ini adalah menggunakan data sekunder dengan mendasarkan pada prinsip-prinsip akuntansi syariah dan etika Islam. Metode analisis yang digunakan adalah metode deskripsikualitatif dengan pendekatan literatur dan kajian normatif. Hal ini dilakukan dengan memeriksa kecurangan pelaporan keuangan dari perspektif hukum Islam. Hasil dari penelitian ini memperkuat teori Fraud Pentagon tentang gejala dan Red Flag Fraud, yang terdiri dari tekanan, peluang, rasionalisasi, kompetensi, dan arogansi para pelaku penipuan. Hal ini bertentangan dengan prinsip hukum Islam yang menekankan pada nilai-nilai kejujuran, keadilan, kebenaran, tanggung jawab, dan kepercayaan dalam pelaporan. Penelitian ini juga menunjukkan lemahnya prinsip etis dalam profesi akuntansi dan jugai religiusitas yang dimiliki oleh akuntan.Kata kunci: Kecurangan akuntansi, Kecurangan Pelaporan Keuangan, Teori Fraud Pentagon, Etika Hukum Islam

Abstract

The treasure of the waqf is a public asset that should be protected by law. Waqf is a legal act that itsimplementation must be in accordance with statutory procedures. Mandatory legal act waqf deed pledgespoured in endowments. But in practice there is still a committed implementation of the waqf notaccording to legal procedures. Implementation of the waqf is not stated in the Deed of Pledge Waqf ashappened in the district Wiradesa Pekalongan thus has no legal force. Departing from this fact researchis needed to describe the implementation of endowments in the District Wiradesa and formulate legalsafeguards against waqf property as a public asset in the District Wiradesa. This research is a fieldresearch. The approach is sociological, thus falling within the scope of empirical legal research. Thecollection of data through observation and interviews. Data were analyzed using the model of induction-interpretation. The results showed that the waqf property in District Wiradesa many do not haveauthentic proof recognized by the law. Necessary legal means to protect the property of the waqf ofpotential irregularities.

Abstract

Social life changes over time. The response to social change and law change is all important. The ideal national law system  Indonesian people expect is Pancasila law system. The problem in this research is First, what is the description of the Pancasila law ideals? Second, why development of national law as implementation of Pancasila law ideals is important? and Third, is national law development also the social change demands? This research employs normative approach which constitutes secondary data in the form of library materials. The analysis applied induction-interpretation-conceptualization. The results show that Pancasila law ideals is an expectation of a law system rooted in Pancasila which is a way of life of the Indonesian nation. The development of national law system is an attempt to establish its own product laws. The importance of national law development is to manifest the Pancasila law ideals. The law development in the context of social change is to meet social change. The national law development will be more effective if initiated from the substance of law.Keywords: Development, national law, ideals of law, Pancasila, social change.

Abstract

AbstractThis thesis addresses the classification of knowledge by Ibn Sina. The goal of this thesis was to decide the classification of knowledge according to Ibn Sina and to what degree the position and effect of Ibn Sina's thinking on the growth of science in Islam. This research is a qualitative literature-based study (library research). The method used is analytical, qualitative, with the goal of presenting a definition or explaining the present reality or what is happening or the current reality of the object under study. The results of this study show that the classification of knowledge according to Ibn Sina divides knowledge into two, namely theoretical knowledge (hikmah nadzariah) which seeks to purify the soul through ma'rifat. What this information requires is the discussion of the questions of metaphysics (divinity), mathematics (riyadhiyah) and physics (thabi'iyah). Second, the functional sciences ('Amaliah'). Included in the area of practical science, such as ethics (Khuluqiyah), regulating family relationships in the household, economics (Tadbir al-Manzil), regulating the association of people within the state (Tadbir al-Madinah) and prophethood (syari'ah).Keywords; Ibn Sina, Classification of Science, theoretical science, practical science. AbstrakStudi ini membahas tentang klasifikasi ilmu menurut Ibn Sina. Dengan tujuan untuk mengetahui klasifikasi ilmu menurut Ibn Sina dan sejauh mana peran dan pengaruh pemikiran Ibn Sina terhadap perkembangan ilmu pengetahuan dalam Islam. Studi merupakan studi kualitatif berbasis kepustakaan (library research). Pendekatan yang digunakan adalah deskriptif kualitatif yang bertujuan untuk memberi gambaran atau mendeskripsikan kenyataan yang ada atau apa yang terjadi atau kenyataan sebenarnya pada obyek yang diteliti. Hasil penelitian ini memperlihatkan bahwa klasifikasi ilmu menurut Ibn Sina ilmu terbagi menjadi dua, yaitu ilmu teoritis (hikmah nadzariyah) bertujuan untuk membersihkan jiwa melalui ma’rifat. Yang termasuk ilmu ini adalah membahas masalah-masalah metafisika (ketuhanan), matematika (riyadhiyah), dan fisika (thabi’iyah). Kedua, ilmu-ilmu praktis (‘Amaliyah). Termasuk dalam bidang ilmu-ilmu praktis seperti etika (Khuluqiyah), mengatur pergaulan keluarga dalam rumah tangga, ekonomi (Tadbir al-Manzil), mengatur pergaulan umat dalam negara (Tadbir al-Madinah) dan kenabian (syari’ah).Kata Kunci; Ibn Sina, Klasifikasi Ilmu, Ilmu teoritis, ilmu praktis.

Abstract

AbstractThis study discussed the thoughts of Muhammad Iqbal about the study of hermeneutics in hadith. The study aimed to find out how Muhammad Iqbal's thought about the study of hermeneutics in hadith. The study is a qualitative study based on the library (library research). The approach used is descriptive qualitative which aimed to illustrate or describe the reality that exists or what is happening or the actual reality of the object under the study. The result of this study showed that Muhammad Iqbal's thought about hermeneutics studies in a hadith is Muhammad Iqbal's thought in the hadith which was originated on an assumption that hadith as a second source that did not miss the contradictions of the people both the truth of the content (matan) and the chain of transmission (sanad) and it became wild critiques by the orientalists from the past time till now on. Iqbal suggested that an in-depth study of the hadith literature by directing the Prophet Muhammad himself as a person who has the authority to interpret his revelations. it is all because the Prophet was the one who knew the true purpose of the message conveyed by Allah SWT well.Keywords: Muhammad Iqbal, Hermeneutika, Hadith AbstrakStudi ini membahas pemikiran Muhammad Iqbal tentang studi hermeneutika dalam hadits. Pendekatan yang digunakan adalah deskriptif kualitatif yang bertujuan untuk menggambarkan atau menggambarkan kenyataan yang ada atau apa yang sedang terjadi atau kenyataan aktual dari objek yang diteliti. Hasil penelitian ini menunjukkan bahwa pemikiran Muhammad Iqbal tentang studi hermeneutika dalam sebuah hadis adalah pemikiran Muhammad Iqbal dalam hadits yang berawal dari asumsi bahwa hadits sebagai sumber kedua yang tidak ketinggalan kontradiksi masyarakat, baik kebenaran dari konten (Matan) dan rantai penularan (sanad), dan itu menjadi kritik liar oleh orientalis dari masa lalu sampai sekarang. Iqbal menyarankan agar penelitian mendalam tentang literatur hadits dengan mengarahkan Nabi Muhammad sendiri sebagai orang yang memiliki wewenang untuk menafsirkan wahyu-wahyunya. Itu semua karena Nabi adalah orang yang mengetahui tujuan sebenarnya dari pesan yang disampaikan oleh Allah SWT dengan baik.Kata Kunci: Muhammad Iqbal, Hermeneutika, Hadits
