ABSTRAKPada umumnya, perkawinan suku Sasak, didahului dengan proses membawa lari (merarik) calon istri. Jika keduanya saling menyukai dan tidak ada paksaan, tanpa meminta izin kepada kedua orangtua, si perempuan dibawa lari untuk dinikahi. Permasalahannya, jika orang tua keberatan dan perempuan yang dibawa lari di bawah umur, biasanya berujung pada meja hijau. Muncul perselisihan paradigma, jika pelaku merarik dijerat hukum pidana bukankah seolah-olah hukum adat tersebut identik dengan kejahatan dari kacamata hukum formal, padahal di sisi lain ia merupakan hukum yang hidup di masyarakat? Putusan hakim dalam kasus merarik tentu tidak “bebas-nilai”, disadari atau tidak, merupakan perselisihan paradigma, yakni sociological jurisprudence yang hendak merekayasa masyarakat menjadi lebih modernis dengan mazhab sejarah yang masih ingin mempertahankan tradisi dan kebiasaan lama.Kata kunci: merarik, perselisihan paradigma, sociological jurisprudence, mazhab sejarah.ABSTRACTIt is quite common the weeding processing in Sasak tribe is preceded with eloping, known as ‘merarik’. The eloping happens if and only if there is no coersion to the girl and both love with each other. The girl is taken away to be married without theparents’ permission. It is a problem if the parents objected and the girl eloped is still under age. This case usually end up in court. A conflict of paradigms occurs, if the man who did ‘merarik’ is brought to criminal justice. The customary law appears to be treated as a crime in formal law perspective, while in fact it is a law living in the society. The judge’s decision in “merarik” case is certainly not “value-free”. Realizing it or not, this is a conflict of paradigms, namely sociological jurisprudence aimed at engineering a more modernist society, and the history school of law which still strives to preserve the old traditions and customs.
