Abstract

Abstract: Qanun Hukum Jinayat only applies to Muslims in Aceh. This conception specifically adopts the principles of personality and territoriality. However, when examined more deeply, it can be seen that the adoption of these two principles was not applicable. The impact that arises is that the Qanun Hukum Jinayat (QHJ) still applies to Muslims and non-Muslims, although with some conditions. This is where the problems start to emerge. This paper is based on an analysis of the contents of the articles of the Qanun on the Jinayat Law, showing that the existence of this Qanun specifically regulates the position of non-Muslims in Aceh. The primary data in this paper are articles in the Jinayat Law Qanun and added with other written sources. It was found that the adoption of the two principles in the Qanun Hukum Jinayat should not eliminate the fundamental principles of Islam which uphold justice and respect human rights. An in-depth and comprehensive study is necessary to produce fairer regulations. Abstrak: Qanun Hukum Jinayat hanya berlaku bagi umat Islam yang berada di Aceh. Konsepsi ini secara spesifik mengadopsi asas personalitas dan teritorial. Namun bila dikaji lebih mendalam, dapat dilihat bahwa pengadopsian kedua asas tersebut ternyata tidak secara total berlaku. Dampak yang muncul bahwa Qanun Hukum Jinayat (QHJ) tetap berlaku bagi umat Islam dan bukan Islam meskipun dengan beberapa persyaratan. Dari sinilah masalah mulai muncul. Tulisan ini atas dasar analisis isi pasal-pasal Qanun Hukum Jinayat menunjukkan bahwa eksistensi Qanun ini khususnya yang mengatur tentang kedudukan non-muslim di Aceh. Data primer dalam tulisan ini adalah pasal-pasal dalam Qanun Hukum Jinayat dan ditambah dengan sumber-sumber tulisan lainnya. Ditemukan bahwa pengadopsian kedua asas dalam Qanun Hukum Jinayat seyogyanya tidak menghilangkan prinsip fundamental Islam yang menjunjung tinggi keadilan dan menghargai hak asasi manusia. Kajian mendalam dan komprehensif mutlak diperlukan untuk menghasilkan peraturan yang lebih adil.
