Model Regulasi Uang Elektronik yang Menerapkan Value Protection

AbstractElectronic money has been used by the Indonesian people as a means of payment, such as in toll payment transactions or buying and selling. However, electronic money circulating in Indonesia has a risk, namely the value of electronic money contained in electronic money storage instruments cannot be returned to consumers if the electronic money storage instrument is lost. This raises the question of whether Indonesia's electronic money regulations have fulfilled the consumer protection aspect and what electronic money regulation models can provide protection to consumers because there are still risks that cannot be prevented by applicable regulations. These questions can be answered with a legal, conceptual and comparative approach. The answer to the question is that the applicable electronic money regulation does not meet the principles of consumer security and safety because it does not regulate Value Protection.Keywords: Autopilot Cars; Transportation Law; Legality of Auto Pilot Cars; Government Act.AbstrakUang elektronik telah digunakan oleh masyarakat Indonesia sebagai alat pembayaran seperti pada transaksi pembayaran tol ataupun jual beli. Namun uang elektronik yang beredar di Indonesia memiliki risiko yaitu nilai uang elektronik yang terdapat pada instrumen penyimpanan nilai uang elektronik tidak bisa di kembalikan kepada konsumen jika instrumen penyimpanan uang elektronik hilang. Hal tersebut menimbulkan pertanyaan apakah regulasi uang elektronik yang berlaku Indonesia telah memenuhi aspek perlindungan konsumen dan apa model regulasi uang elektronik yang dapat memberikan perlindungan pada konsumen karena masih ada risiko yang tidak bisa di cegah oleh regulasi yang berlaku. Pertanyaan tersebut dapat dijawab dengan pendekatan peraturan undang-undang, konseptual dan komparatif. Jawaban pertanyan tersebut adalah regulasi uang elektronik yang berlaku belum memenuhi asas keamanan dan keselamatan konsumen karena tidak mengatur mengenai Value Protection.
