<![CDATA[Studi bertujuan untuk menganalisa pengaturan dan kepastian hukum deponering oleh jaksa agung menurut asas oportunitas yang diatur pada sistem peradilan pidana indonesia. Studi ini ditulis menggunakan metode yuridis normatif yang melibatkan pendekatan peraturan perundang-undangan serta analisis konsep hukum. Hasil studi menunjukkan pengaturan indikator deponering memuat suatu kekaburan norma yang berakibat pada ketidakpastian hukum. Frasa kepentingan umum terdapat di Pasal 35 ayat (1) huruf c Undang-Undang Kejaksaan tidak dicantumkan mengenai indikator penentu dan mempunyai arti yang luas bagi Jaksa Agung sebagai pemegang kewenangan deponering. Selain itu, untuk menjamin kepastian hukum deponering oleh Jaksa Agung, Undang-Undang Kejaksaan perlu untuk direvisi dengan memperjelas indikator dari kepentingan umum. ABSTRACT This aimed to analyze the provisions and legal certainty of deponering authority possessed by the Attorney General according to the principles of opportunity in the Indonesian criminal justice system. This journal uses normative juridical research methods that include statutory and analysis approaches. Results of this journal indicate that the deponering provisions do not have clear provisions that resulted in the existence of legal uncertainty. The phrase of public interest governed under Article 35 paragraph (1)(c) of the Attorney Statutory doesn’t have a clear indicator and can be broadly interpreted by the Attorney General as the holder of the deponering authority. Moreover, to guarantee the legal certainty on the application of deponering, a revision of the Attorney Statutory is needed to give legal certainty to the indicator of public interest.
