<![CDATA[ABSTRAKPenelitian ini bertujuan untuk mengetahui eksistensi kedudukan anak sebagai korban dalam perkara perlindungan anak dalam putusan pengadilan negeri Tenggarong Nomor 38/Pid.Sus/2019/PN Trg melibatkan korban anak berusia 17 tahun yang dibujuk oleh terdakwa untuk melakukan hubungan seksual dan sebelumnya dijanjikan untuk dinikahi. Penelitian ini merupakan penelitian hukum doktrinal atau normatif, bersifat preskriptif dan terapan. Sumber bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder, pengumpulan bahan hukum dengan cara studi pustaka, menggunakan pendekatan kasus dan teknik analisis bahan hukum menggunakan metode silogisme dan interpretasi dengan menggunakan pola berpikir deduktif. Berdasarkan hasil penelitian ini dapat diambil simpulan bahwa, Keterangan korban harus dipertimbangkan hakim dalam memutus perkara. Namun untuk menilai kebenarannya perlu dilihat juga persesuaian keterangan anak tersebut dengan alat bukti lain.Kata Kunci : kedudukan korban ; persesuaian alat bukti ; perlindungan anak ABSTRACTThis study aims to determine the existence of the child's position as a victim in a child protection case in the Tenggarong District Court decision No. 38 / Pid.Sus / 2019 / PN Trg involving victims of 17-year-old children constrained to have sexual relations by the defendant and had previously been promised to be married. This research is a doctrinal or normative legal research, which are prescriptive and applied. Sources of legal materials used are primary and secondary legal materials, by means the collection of legal materials is using case approach and the technique to analyze this legal material is using the syllogism method with interpretation using deductive thinking patterns. From this research it can be concluded that, the statement of the victim must be considered by the judge in deciding the case. However, to assess the truth, it is also necessary to look at the compatibility of the child's statement with other evidence.
