Abstract

ABSTRAK: Penelitian ini bertujuan mengkaji kekuatan pembuktian saksi keluarga sedarah dalam proses perceraian. Penelitian ini merupakan penelitian hukum normatif bersifat preskriptif, dengan pendekatan kasus. Bahan hukum yang digunakan hukum primer dan sekunder, yang dianalisis dengan teknik penalaran hukum yang bersifat silogisme dengan metode deduktif. Berdasarkan hasil penelitian dan pembahasan yang dilakukan diperoleh kesimpulan bahwa keterangan yang diberikan oleh saksi keluarga sedarah dimuka persidangan dalam proses perceraian mempunyai kekuatan pembuktian yang sama kedudukannya dengan alat bukti saksi dimana hakim bebas, yang berarti hakim tidak terikat dengan keterangan para saksi yang disampaikan dipersidangan.Kata Kunci : Kekuatan Pembuktian, Saksi Keluarga, Perkara PerceraianABSTRACT: This study aims to examine the strength of proof of blood family witnesses in the divorce process.This research is a prescriptive normative legal research, with a case approach. The legal material used is primary and secondary law, which is analyzed using a syllogistic legal reasoning technique with a deductive method.Based on the results of the research and discussion carried out, it was concluded that the information given by blood family witnesses before the trial in the divorce process had the same evidentiary power as witness evidence where the judge was free, which meant the judge was not bound by the testimony of the witnesses presented in court.Keywords: Strength of Evidence, Family Witness, Divorce Cases
