Penyelesaian Sengketa Sertifikat Hak Milik Atas Tanah: Studi SMP Negeri 2 Cina Kabupaten Bone

Tujuan penelitian: (1) Untuk mengetahui penyelesaian sengketa sertifikat hak milik di atas SMP Negeri 2 Cina Kabupaten Bone; dan (2) Untuk mengetahui faktor-faktor yang mempengaruhi penyelesaian sengketa sertifikat hak milik di atas tanah SMP Negeri 2 Cina Kabupaten Bone. Peneltiian ini menggunakan tipe penelitian hukum normatif. Hasil penelitian menunjukkan bahwa: (1) Penyelesaian sengketa sertifikat hak milik di atas tanah SMP Negeri 2 Cina Kabupaten Bone dianggap cacat hukum karena dasarnya lemah, dimana sertifikat SMP Negeri 2 Bone lebih dahulu terbit dibanding sertifikat hak milik masyarakat dan dasar penerbitannya dibuat oleh aparat desa yang berpihak ke masyarakat, sehingga Pemda Bone melakukan gugatan hukum ke Pengadilan guna mendapatkan kepastian hukum di atas tanah SMP Negeri 2 Kabupaten Bone, yang telah dikuasai puluhan tahun oleh pihak sekolah dan digunakan untuk kegiatan belajar mengajar yang berlangsung hingga sekarang; dan (2) Faktor substansi hukum, struktur hukum, budaya hukum, sarana dan prasarana, dan faktor masyarakat berpengaruh terhadap penyelesaian sengketa sertifikat hak milik di atas tanah SMP Negeri 2 Cina Kabupaten Bone. The purpose: (1) To find out the resolution of ownership certificates disputes above SMP Negeri 2 Cina Bone Regency; and (2) To find out the factors influencing the resolution of ownership certificates disputes on SMP Negeri 2 Bone Bone China This study uses the type of normative legal. The results of the study show that: (1) Settlement of ownership certificates disputes on the land of SMP Negeri 2 Bone China is considered to be legally flawed because the basis is weak, where the certificate of SMP Negeri 2 Bone was issued earlier than the certificate of community ownership and the basis of its issuance was made by village officials in favor of the community, so that the Regional Government of Bone conducts a lawsuit to the Court in order to obtain legal certainty on the land of Bone District 2 Junior High School, which has been controlled for decades by the school and is used for teaching and learning activities that have continued until now; and (2) Factors of legal substance, legal structure, legal culture, facilities and infrastructure, and community factors influence the resolution of ownership certificates disputes on SMP Negeri 2 Bone Bone China.
