<![CDATA[Penelitian ini bertujuan untuk mengetahui bagaimana bentuk kejahatan dunia maya dalam prespektif hukum pidana islam serta untuk mengetahui kejahatan dunia maya menurut prespektif hukum pidana islam. Hasil penelitian ini menujukkan bahwa: (1) Kejahatan dunia maya (cyber crime) dalam prespektif hukum islam belum bisa diterapkan dalam Negara Republik Indonesia, (2) Sanksi bagi para pelaku cyber crime menurut syariat islam adalah Ta’zir melalui proses peradilan dengan vonis hakim dengan ancaman hukuman berupa kurungan penjara, pegasingan, cambuk sampai pada hukuman mati sesuai tingkat mudharat yang telah dilakukannya. This study aims to determine how cyber crime forms in the perspective of Islamic criminal law and to find out cyber crime according to the perspective of Islamic criminal law. The results of this study indicate that: (1) Cyber crime in the perspective of Islamic law cannot be applied in the Republic of Indonesia, (2) Sanctions for perpetrators of cyber crime according to Islamic law are Ta'zir through a judicial process with a judge's verdict. with the threat of punishment in the form of imprisonment, pegasingan, flogging up to the death penalty according to the level of harm he has done.]]>
