The provisions regarding the minimum age limit for marriage are now increasing as stipulated in Article 7 paragraph (1) of Law No. 16 of 2019, namely for women to be 19 years equated with men. Setting a minimum age of marriage that differs between men and women will lead to discrimination and unfulfilled child rights. The age limit of 19 years for lawmakers is considered to have matured his body soul to hold a marriage so that the purpose of marriage is realized and without ending in divorce. Constitutional Court Decision No. 22/PUU-XV/2017 on Testing of Law No. 1 of 1974 ordered the establishment of the Law to make changes to Law No. 1 of 1974 on changes to Law No. 1 of 1974 on Marriage.Based on the above on October 14, 2019, the President of the Republic of Indonesia passed Law No. 16 of 2019 on Amendments to Law No. 1 of 1974 on Marriage which changes the provisions of Article 7. Article 7 paragraph (1) has the aim of eliminating discrimination and basic rights by preventing the occurrence of underage marriages that are at high risk to both maternal and infant health and formal education of women due to dropping out of school.
