Abstract

Pembangunan Kawasan Usaha Pusat Perbelanjaan menjadi salah satu faktor yangdominan terjadinya dampak lalu lintas. Salah satunya adalah pembangunan kawasanUsaha Pusat Perbelanjaan dan Hotel Rita, walaupun sudah diwajibkan menyusundokumen andalalin pada kenyataannya masih menimbulkan dampak lalu lintas.Tipe penelitian hukum Doktrinal (Normatif), metode pendekatan Perundanganundangan dan Pendekatan Konseptual.Perbelanjaan dan Hotel Rita Menurut Peraturan Menteri Perhubungan Nomor 75Tahun 2015, adalah sebagai berikut: a. Abstract

Humanitarian principle aims to protect and ensure respect for the human. This research uses a normative, and the research also applies a descriptive-analytical approach to examine and analyse the research questions of the thesis. In doing so, this research uses a secondary data, These legal materials are subsequently analysed using a qualitative juridical approach.The results showed that the First, the concept of legal protection of prisoners of war under the Geneva Convention III 1949 indicates that the combatants who have the status of 'hors de combat' must be protected and respected in all circumstances. Tribute in the form of an obligation not to commit acts harmful, do not aggravate the situation, and do not kill people who are protected. Penahanpun state obligation to prevent harm and damage; Second, implementation of the Geneva Convention III 1949 against US prisoners of war in Guantanamo is not optimal. This happens because of differences in the interpretation of the Articles in International Humanitarian Law so as to cause the indication practices inhumane treatment, no legal protection, not considered welfare and not related to the outside world at Guantanamo will be undertaken by the US military guards.Keywords: Respect, Humanity, Prisoner of War, Armed Conflict, Guantanamo

Abstract

Implementation of the programmed government's health is a national health insurance is BPJS. BPJS Health seeks to provide legal protection to participants Not PBI especially in health facilities in hospitals Banyumas. The method used is specific normative juridical with descriptive analytical, secondary data sources, approach to law and analytical approach. The study was conducted at Hospital Banyumas and PII UNSOED. Therefore concluded legal protection of participants Not PBI not inpatient national health insurance in hospitals Banyumas form of preventive rights, the right to curative, rehabilitative rights both administratively and medically. The legal protection of participants Not PBI not inpatient national health insurance in hospitals Banyumas a right of preventive, rights curative, right rehabilitative both administratively and medically well as the right form of accommodation in the form of class hospitalization non intensive consisting of classrooms III, classroom II, I classrooms and intensive inpatient treatment.Keywords: Hospital Banyumas. Abstract

Referring to Law no. 16 of 2004 which replaces Law no. 5 of 1991 on the Prosecutor's Office R.I., the Attorney as one of the law enforcement agencies are required to play a more role in upholding the rule of law, protection of public interest, human rights enforcement, and eradication of Corruption, Collusion and Nepotism (KKN). In the new Law of the Prosecutor's Office, the Public Prosecution Service as a state institution exercising state power in the prosecution field must perform its functions, duties and authority independently, irrespective of the influence of the power of government and the influence of other powers (Article 2 paragraph 2 of Law No. 16 Year 2004).In carrying out its duties and authority, the AGO is led by the Attorney General who oversees six Junior Attorneys and 31 High Chief Prosecutors in each province. UU no. Law No. 16 of 2004 on the Attorney of the Republic of Indonesia also suggests that the AGO is in a central position with a strategic role in strengthening the nation's resilience. Because the AGO is in the axis and a filter between the investigation process and the examination process in the court as well as the executor of court decisions and decisions. Thus, the Prosecutor's Office is the controller of the case proceedings (Dominus Litis), since only the Attorney-General's office can determine whether a case may be brought to the Court or not based on valid evidence according to the Criminal Procedure Code.The Cilacap District Attorney Obstacles faced in seeking diversion for child criminal cases with the first obstacle is that most of the criminal acts committed by the threat are more than 7 years imprisonment so that they can not be diversi- fied in accordance with Law Number 11 Year 2012 on Child Criminal Justice System, the second obstacle is the Cilacap State Attorney has 15 (fifteen) prosecutors and only 2 (two) prosecutors have the Decree from the Attorney General and have attended the training as a condition to be prescribed as the Child Procurator and have the right hear the children's case. Of course, with the number of 2 (two) public prosecutors is very less considering the high number of children's case volume in Cilacap District Court, so that prosecutors who do not have a decree are appointed to hear cases of children, the community's assessment that there is no firmness in law enforcement when resolved through diversion. In addition, the community's view of the diversion process tends to be negative which results in the occurrence of resentment and exclusion for children in conflict with the law and the community still wants to retaliate for the perpetrator by imposing penalties or criminal charges, the attitude of the victim's family who assumes a diversionary process will only free the child from responsibility for his deeds

Abstract

Mask dance and the folklore Sintren in Cirebon, this needs to be raised, given the many meanings and values contained therein. Therefore the legal instruments in use today need to be evaluated. Legal protection of folklore has unwittingly become a big problem and quaint because not any legislation in Indonesia who set about legal protection of intellectual property. The Research Type is normative-empirical research. The approximation methods are two kinds; first problem using a legislation conceptual and analytical approach and purposive sampling for the second problem. The data source consist of primary data and secondary data. The research on the legal protection of Topeng dance and Sintren at Cirebon is Preventive Legal Protection is a regulation made by central and local government related to folklore including copyright laws number 19 of 2002 especially arranged in section 10, local regulation of West Java Province Number 5 of 2012 about Intellectual Property Protection and both central and local government policies that related to folklore; Represive Legal Protection is a legal protection effort undertaken by the state in case there are claims of the other states upon Indonesia folklore.Keywords: Legal Protection, Copyright, Topeng dance and Sintren

Abstract

The nurse’s role was caring and giving comfort to the client, which the nurse doing their position as a specific nurse, nowever, recently the nurse’s role have being expanded into  healthcare improvement and prevention of disease (prophylaxis), and also considering patient comprehensively. Nurse is demanded to have science and skill in all aspects of nursing care. Nurse as a proffesional employee, has some responsibility and authority to care and treat client independently, being able in consulting and collaborating with other health workers based on their authority, particularly related to the scope of nursing work.This research is aimed at analysis of The Implementation of the Nurse’s Authority to Consultate and Collaborate with The Doctor based on Law No. 38/2014 about Nursing which held in RSUD Dr. Soedirman Kebumen. This reseach is qualitative sociological juridical aproach, retrieval of data through observation, quisioner, the threty nurse and four informant.This research result is represented that The Implementation of the Nurse’s Authority to Consultate and Collaborate with The Doctor based on Law No. 38/2014 about Nursing section 30 of article 1 which held in RSUD Dr. Soedirman Kebumen, indicated to ‘ ineffective implementation’. This is evidenced that still many of nurses found did not do consultate and collaborate with the doctor or other health workers neither onto health service nor onto making the nursing care.Therefore, related to this infringement of law, the Nursing Concil may determine discipline of sanction to the nurse, based on Law no. 38 / 2014 section 49 and 50 about Nursing.The barrier and obstacle of the implementation of the nurse’s authority to consultate and collaborate with the doctor onto health service are: 1. The explanation of Law no. 38/2014 about what kind of expected consultation and collaboration between nurse and other health worker expecially with the doctor, is blurred. 2. Controlling and monitoring to the nurse’s ethos of work is low. 3. Level of nurse’s education is under qualify. 4. Low experience of Nurse. 5. Abstract

This study aimed to know law enforcement of clinics employing illegal nurses,and knowing that factors that tend to affect law enforcement. Law Research (Legal Research) done used this type of socio legal studies. The data sources included primary data in this study form an opinion from the respondents in this case include the parties involved directly or indirectly, namely District of health office Cilacap, and 5 clinic. While secondary data sources covered legislation, literature and official document relating to the subject matter. The result of the research is,not implemented law enforcement by District of health office Cilacap. It is seen that there is no function of Head of District Health Office Cilacap in coaching and supervision

Abstract

Penelitian ini mengangkat permasalahan perlindungan hukum nasabah ataspenjualan data nasabah bank dan pengawasan OJK terhadap kewajiban kerahasiaanatas penjualan data nasabah bank. Penelitian ini dilakukan untuk menganalisisperlindungan hukum nasabah atas penjualan data nasabah bank dan menganalisispengawasan OJK terhadap kewajiban kerahasiaan atas penjualan data nasabah bank. Tesis ini menggunakan penelitian hukum normatif karena menitikberatkan pada penelitian kepustakaan yang intinya meneliti asas-asas hukum, sistematis hukum, dan sinkronisasi hukum dengan cara menganalisanya. Data yang diperoleh dianalisis dengan menggunakan metode normatif kualitatif. Hasil penelitian menemukan bahwa Perlindungan hukum nasabah atas penjualan data nasabah bank dapat dikatakan bahwa perlindungan hukum tersebut sudah diatur dengan adanya SEOJK Nomor 14 Tahun 2014 Tentang Kerahasiaan dan Keamanan Data dan/atau Informasi Pribadi Konsumen, dan POJK Nomor 1 Tahun 2013 Tentang Perlindungan Konsumen Sektor Jasa Keuangan. Pelaksanaan pengawasan OJK terhadap kewajiban kerahasiaan atas penjualan data nasabah bank dalam hal ini dilihat dari sisi pengawasan market conduct jasa keuangan perbankan oleh OJK, secara keseluruhan sudah dilaksanakan oleh Kantor OJK, namun belum dilaksanakan sepenuhnya oleh OJK di wilayah/daerah seperti OJK kabupaten/kota.

Abstract

The Research purpose to analyze the implementation of law protection for doctors in the emergency service unit at the Abdul Wahab Sjahranie Samarinda and to analyze the solutions applied by the emergency unit to resolve the issues regarding to the law protection. Research methodology uses the ‘yuridis normatif’ approach where the research type to find law ‘in concreto’. The research is conducted at the Abdul Wahab Sjahranie Hospital in Samarinda. Based on the research results, the implementation of law protection for doctros in the emergency unit at the Abdul Wahab Sjahranie Samarinda has been applied according to the Law and Regulation in Indonesia therefore the doctors have practiced the medical actions following the standard operational procedures (SOP). In this case, they are not able to be prosecuted in the event of mistreatment and to resolve the medical dispute, the hospital employs the mediation process called Alternative Dispute Resolution (ADR) according to Articles No. 36 Year 2009 about health chapter 29 that states in the event of negligence by doctors in conducting medical actions, is able to be settled by mediation.Key words : Alternative Dispute Resolution, emergency.

Abstract

This research aimed to find out the form and coordination effectiveness between the Government Intern Controlling Apparatus with the Investigator  in handling the criminal act of corruption in the Regency of Banyumas  This research used the sociology juridical approach. Data in this research was obtained by interview with the Public Attorney Investigator of Banyumas. The Tipikor Unit Investigator  Reskrim Polres Banyumas and Inspektorat Banyumas  and  collecting  many of the  certainty ordinance regulation, documentation, literature and accessing  internet.   Based on the  result of research and  discussion  could be  taken  the  conclusion of. Coordination between APIP and Investigator  did not have  the  clearness  in  technique  and criteria act of State Civil Apparatus which one was  categorized   in the scope of  criminal act that became  the  authority of Investigator  or in the scope of  administration  that  became the authority of APIP with the Investigator  in handling the  criminal act of corruption   was not  being effective  because of ego sectoral between APIP and Investigator and the necessity of disposition of regebts so that APIP can not work objectively and take a very long time. Keywords: APIP, Coordination, Investigator
