<![CDATA[ABSTRAKPenelitian ini mengkaji permasalahan mengenai pertimbangan Mahkamah Agung memutus permohonan kasasi Penuntut Umum berdasarkan alasan Judex Facti keliru menafsirkan peraturan hukum berdasarkan Pasal 253 ayat (1) KUHAP. Penelitian ini merupakan penelitian hukum normatif bersifat preskriptif dan terapan. Pendekatan yang digunakan yaitu pendekatan undang-undang dan pendekatan kasus. Sumber data diperoleh dari bahan hukum primer dan sekunder. Teknik pengumpulan bahan hukum dalam penelitian ini adalah studi kasus. Bahan hukum yang diperoleh kemudian diolah menggunakan metode silogisme deduktif. Permohonan kasasi Penuntut Umum dikabulkan oleh Majelis Hakim Mahkamah Agung dan putusan sebelumnya dibatalkan serta diadili sendiri oleh Mahkamah Agung pada Putusan Mahkamah Agung berdasarkan Pasal 253 ayat (1) dan Pasal 256 ayat (1) KUHAP jo. Pasal 255 ayat (1) KUHAP.Kata Kunci: Korupsi, Kasasi, Keliru Menafsirkan Peraturan Hukum. ABSTRACTThis study examines the problems regarding the consideration of the Supreme Court to decide upon the Public Prosecution Cassation Application based on the reasons Judex Facti misinterpreted the legal regulations based on Article 253 paragraph (1) of the Criminal Procedure Code. This study is a normative legal research that is prescriptive and effective. The approach used is the law approach and case approach. Data sources were obtained from primary and secondary legal materials. The legal material collection technique in this study is a case study. Legal matters obtained are then processed using deductive syllogism methods. The Cassation Appeal of the Public Prosecutor was granted by the Supreme Court Judges and the previous decision was canceled and tried by the Supreme Court on the Decision of the Supreme Court based on Article 253 paragraph (1) and Article 256 paragraph (1) KUHAP jo.
