TINJAUAN YURIDIS TERHADAP PENYALAHGUNA NARKOTIKA DENGAN REHABILITASI DAN PUTUSAN PIDANA PENJARA (STUDI KASUS PUTUSAN PN YOGYAKARTA)

Abstract

ABSTRAK: Penyalahguna atau korban penyalahgunaan narkotika wajib untuk mendapatkan rehabilitasi baik dari rehabilitasi medis maupun rehabilitasi sosial sebagaimana maksud dari Pasal 127 ayat (3) Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika. Akan tetapi di dalam Putusan Pengadilan Negeri Yogyakarta Nomor: 145/Pid.Sus/2021/PN. Yyk justru penyalahguna atau korban penyalahgunaan narkotika diberikan hukuman penjara, sehingga menarik untuk dilakukan penelitian. Metode dalam penelitian ini menggunakan metode doktrinal dengan pendekatan kasus (case approach) dan pendekatan Undang-Undang (statuse approach). Pengumpulan bahan hukum menggunakan studi kepustakaan (library research) dengan teknik analisis bersifat deduktif. Hasil penelitian menunjukan bahwa kewajiban rehabilitasi bagi penyalahguna atau korban penyalahgunaan narkotika sebagai amanah dari Pasal 54 Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika, hal ini karena penyalahguna atau korban penyalahgunaan narkotika merupakan seseorang yang sakit secara fisik beserta mental sehingga harus direhabilitasi. Putusan pidana penjara selama 1 (satu) tahun dalam Putusan Pengadilan Negeri Yogyakarta Nomor: 145/Pid.Sus/2021/PN. Yyk telah memenuhi unsur-unsur pada Pasal 127 ayat (1), akan tetapi apabila mengacu pada prinsip keadilan restoratif bahwa penjatuhan pidana bagi pecandu narkotika tidak tepat karena tidak berorientasi pada pemulihan namun justru berorientasi pada pembalasan.Kata kunci: Tindak Pidana Narkotika; Rehabilitasi; Pecandu dan Korban Penyalahgunaan Narkotika. Abstract: Addicts and victims of narcotics abuse are obliged to get rehabilitation, both from medical rehabilitation and social rehabilitation. However, in the Yogyakarta District Court Decision Number: 145/Pid.Sus/2021/PN. In fact, addicts and victims of narcotics abuse are given prison sentences. This is contrary to the principles of restorative justice and the orientation of the Narcotics Law which prioritizes rehabilitation for addicts and victims of narcotics abuse. The method in this study uses a doctrinal method with case approach and a status approach. The collection of legal materials uses library research with deductive analysis techniques. The results of the study show that the obligation of rehabilitation for addicts and victims of narcotics abuse is based on Article 54 of the Narcotics Law, this is based on the fact that addicts and victims of narcotics abuse are someone who is physically and mentally sick so they must be given care and treatment in the form of rehabilitation. Furthermore, despite the imprisonment for 1 (one) year in the Yogyakarta District Court Decision Number: 145/Pid.Sus/2021/PN. Yyk has fulfilled the elements in Article 127 paragraph (1), however, when referring to the principle of restorative justice, that the imposition of a criminal offense for narcotics addicts is not appropriate because it is not oriented towards recovery but is instead oriented towards revenge. In addition, imprisonment also hinders the right to obtain health services for prisoners addicted to narcotics.Keywords: Narcotics Crime; Rehabilitation; Addicts and Victims of Narcotics Abuse
