Abstract

Penelitian bertujuan untuk mengetahui unsur-unsur tindak pidana dalam kejahatan merek.dan untuk mengetahui penerapan sanksi pidana dalam kejahatan merek di Kota Makassar. Hasil penelitian menunjukkan ini bahwa unsur-unsur tindak pidana dalam kejahatan merek ada 2 (dua) yaitu pertama unsur obyektif yang pada umumnya unsur ini terdiri atas suatu perbuatan ataupun suatu akibat, yang kedua unsur subyektif yang terdiri atas suatu kehendak atau tujuan, yang terdapat di dalam jiwa pelaku, unsur dirumuskan dengan istilah sengaja, niat, dan maksud. Apabila unsur-unsur pidana terhadap kejahatan mereka telah terpenuhi maka sanksi pidana sebagaimana diatur dalam pasal 100 Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis pidana paling lama 10 (sepuluh) tahun dan/atau denda paling banyak Rp. 5000.000.000.00 (lima miliar rupiah) This research purpose of the research conducted by the author is to find out the elements of a crime in brand attacks and to find out the application of criminal sanctions in brand crimes in Makassar City. The results of the study indicate that there are 2 (two) elements of criminal acts in brand crimes, namely the first is not objective, which generally does not consist of an act or an effect, the second is not subjective, which consists of a will or purpose, which is contained in the soul. perpetrator, is not formulated in terms of intention, intention, and intent. If the elements of a crime against a crime have been fulfilled, the sanctions as stipulated in Article 100 of Law Number 20 of 2016 concerning Marks and Geographical Indications shall be criminalized for a maximum of 10 (ten) years and/or a maximum fine of Rp. 500,000,000.00 (five billion rupiah).
