<![CDATA[Penelitian ini bertujuan untuk mengetahui: pelaksanakan dan faktor penghambat restorative justice dalam menyelesaikan tindak pidana kecelakaan lalu lintas di Kepolisian Resor Kota Besar Makassar. Penelitian ini merupakan penelitian hukum Normatif Empiris dengan pendekatan kualitatif yang dilakukan di Kepolisian Resor Kota Besar Makassar, khususnya pada Unit Kecelakaan Satuan Lalu Lintas. Metode yang digunakan adalah wawancara, obesrvasi dan dokumentasi. Hasil Penelitian Pelaksanaan restortative justice dalam penyelesaian tindak pidana kecelakaan lalu lintas di Kepolisian Resor Kota Besar Makassar belum berjalan secara optimal berdasarkan Peraturan Kepolisian Negara Republik Indonesia No 8 tahun 2021 tentang Penanganan Tindak Pidana berdasarkan Keadilan Restoratif dengan bersandar pada dua syarat yaitu syarat formil dan syarat materil. Kedua syarat tersbut diantaranya tidak adanya perdamaian kedua belah pihak yang menjadi syarat formil sehingga menjadi tidak terpenuhinya syarat materil untuk memenuhi adanaya kata sepakat. Faktor yang menghambat kepolisian khususnya Penyidik Polrestabes Makassar dalam penyidikan pelanggaran lalu lintas yang menyebabkan kecelakaan lalu lintas di wilayah Polrestabes Makassar terdiri atas dua faktor yaitu faktor internal berupa sarana dan prasarana dan hukum dan faktor eksternal berupa Kesadaran hukum dan budaya This study aims to determine the implementation and inhibiting factors of restorative justice in resolving traffic accidents at the Makassar City Police Resort. This research is an empirical normative legal research with a qualitative approach carried out at the Makassar City Police Resort, especially in the Traffic Unit Accident Unit. The method used is interview, observation and documentation. Research Results from The implementation of restorative justice in settlement of traffic accidents at the Makassar City Police Resort has not run optimally based on the Indonesian National Police Regulation No. 8 of 2021 concerning the Handling of Crimes based on Restorative Justice by relying on two conditions, namely formal requirements and material requirements. The two conditions include the absence of peace between the two parties, which is a standard requirement that the content requirements are not fulfilled to fulfil the agreement. The factors that hinder the police, especially the Makassar Polrestabes Investigators, in investigating traffic violations that cause traffic accidents in the Makassar Polrestabes area consist of two factors, namely internal factors in the form of facilities and infrastructure and law and external factors in the state of legal and cultural awareness.]]>
