<![CDATA[Tujaun penelitian menganalisis kekuatan mengikat Kontrak Baku Pada Berbagai Perjanjian serta faktor-faktor yang mempengaruhi terciptanya Kontrak Baku Pada Berbagai Perjanjian di Kota Makassar. Tipe penelitian adalah penelitian hukum empiris. Hasil penelitian bahwa Hakikat kontrak baku (Perjanjian) bagi para pihak yakni terciptanya sebuah perjanjian yang berkeadilan, berkepastian dan bermanfaat bagi para pihak yang terlibat. 2) Bahwa kontrak baku (standard contract), cenderung merugikan pihak debitur/konsumen, karena substansi (clausule) dibuat sepihak oleh kreditur sehingga memuat hak dan kewajiban yang tidak seimbang. 3) Faktor-Faktor Yang Mempengaruhi Keberadaan Sebuah Kontrak Baku (Standard Contract) yakni faktor Provit/keuntungan, penggunaan waktu, kesadaran hukum debitur, proses yang mudah, dan ekonomi debitur. The research objective is to analyze the binding strength of Standard Contracts in Various Agreements and the factors that influence the creation of Standard Contracts in Various Agreements in Makassar City. This type of research is empirical legal research. The results of the study show that the essence of a standard contract (agreement) for the parties is the creation of an agreement that is fair, certain and beneficial to the parties involved. 2) Whereas the standard contract tends to harm the debtor/consumer, because the substance (clausule) is made unilaterally by the creditor so that it contains unequal rights and obligations. 3) Factors Affecting the Existence of a Standard Contract, namely profit/profit factors, use of time, legal awareness of the debtor, easy process, and the debtor's economy.]]>
