ANALISIS ADA TIDAKNYA PENYIMPANGAN PRINSIP PERADILAN STARE DECISIS DALAM PENJATUHAN PUTUSAN OLEH HAKIM

Abstrak: Penelitian ini bertujuan untuk mengetahui ada tidaknya penyimpangan Prinsip Peradilan Stare Decisis dalam menjatuhkan putusan nomor 380/Pdt.G/2021/PN Mdn dan Nomor 604/Pdt.G/2021/PN Mdn oleh Hakim. Penelitian ini merupakan penelitian hukum normatif yang bersifat deskriptif dengan pendekatan kasus. Penelitian ini menggunakan jenis dan sumber bahan hukum yang terdiri dari bahan hukum primer dan sekunder. Teknik pengumpulan bahan hukum dilakukan dengan cara studi kepustakaan. Dari hasil penelitian ini diketahui bahwa Hakim dalam menjatuhkan Putusan Nomor 380/Pdt.G/2021/PN Mdn dan Nomor 604/Pdt.G/2021/PN Mdn tidak mengikuti prinsip peradilan stare decisis karena hakim memutuskan bahwa hak asuh anak di bawah umur jatuh kepada ayahnya. Jika Hakim mengikuti prinsip peradilan stare decisis maka akan merujuk pada Putusan Mahkamah Agung No. 102 K/Sip/1973 tanggal 24 April 1975, No. 423 K/Sip/1980 tanggal 23 September 1980, dan No. 126 K/Pdt/2001 28 Agustus 2003 yang menyatakan bahwa hak asuh anak yang masih di bawah umur jatuh kepada ibunya.Kata Kunci: Hak Asuh Anak;Penyimpangan;Stare DecisisAbstract: This research aims to determine whether there is a deviation from the Principle of Stare Decisis in the issuance of Decision number 380/Pdt.G/2021/PN Mdn and Decision number 604/Pdt.G/2021/PN Mdn by the Judge. This research is a normative legal research that is descriptive in nature with a case approach. This research uses types and sources of legal materials consisting of primary and secondary legal materials. The technique for collecting legal materials is done through literature study. From the results of this research, it is known that the Judge in issuing Decision number 380/Pdt.G/2021/PN Mdn and Decision number 604/Pdt.G/2021/PN Mdn did not follow the principle of stare decisis because the judge ruled that custody of children under age fell to their father. If the Judge follows the principle of stare decisis, it will refer to the Supreme Court Decision No. 102 K/Sip/1973 dated April 24, 1975, No. 423 K/Sip/1980 dated September 23, 1980, and No. 126 K/Pdt/2001 August 28, 2003 which stated that custody of children under age falls to the mother.Keywords: Chils custody;Deviation;Stare Decisis
