<![CDATA[Abstract Children are a gift from God that must be cared for and protected. As times and technology develop, the nature and character of children also develops, but not infrequently in some cases children who should receive protection and affection instead become perpetrators or victims of acts of violence that occur. As in the Audrey case, where the perpetrator is a child and the victim is also a child. Fellow children become perpetrators and victims in cases of violence. However, considering that the perpetrators are minors in criminal convictions, they cannot be equated with general crimes and the juvenile justice system. In the juvenile justice system, it is mandatory to prioritize restorative justice approaches, which include investigations, prosecutions and trials of children who must seek diversion as well as guidance, guidance, supervision and/or assistance during the process of carrying out a crime or act and after serving a crime or action. Based on the research, diversion was carried out at the police level with the Pontianak Police Criminal Investigation Unit PPA facilitator, but experienced up to the stage of investigation and handing over of files to the prosecutor's office. As a result of the cancellation of the diversion agreement, the case continued to the trial stage at the Pontianak District Court with the issuance of the Pontianak District Court Decision Number 11/Pid.Sus-Anak/2019/Pn-Ptk, the perpetrator was given coaching for 3 months in one of the Social Service Institutions in Pontianak. Semakin berkembang nya zaman dan teknologi, sifat dan karakter anak pun berkembang, namun tak jarang di beberapa kasus anak yang seharusnya mendapatkan perlindungan dan kasih sayang malah menjadi pelaku maupun korban dari tindak kekerasan yang terjadi. Seperti halnya pada kasus Audrey, dimana pelaku adalah anak dan korban pun juga adalah anak. Anak sesama anak menjadi pelaku dan korban pada kasus kekerasan. Akan tetapi, mengingat pelaku yang merupakan anak dibawah umur dalam penjatuhan pidana tidak bisa disamakan dengan pidana umum dan sistem peradilan anak. Dalam sistem peradilan anak wajib mengutamakan pendekatan keadilan restoratif, yang mana meliputi penyidikan, penuntutan dan persidangan anak yang wajib diupayakan diversi serta pembinaan, pembimbingan, pengawasan dan/atau pendampingan selama proses pelaksanaan pidana atau tindakan dan setelah menjalani pidana atau tindakan.Berdasarkan penelitian, diversi dilaksanakan pada tingkat kepolisan dengan fasilitator Polresta Pontianak bagian Reskrim PPA, namun mengalami hingga naik ke tahap penyidikan dan pelimpahan berkas ke kejaksaan. Akibat dari pembatalan kesepakatan diversi tersebut mengakibat berlanjutnya perkara ke tahap persidangan di Pengadilan Negeri Pontianak dengan dikeluarkannya Putusan Pengadilan Negeri Pontianak Nomor 11/Pid.Sus-Anak/2019/Pn-Ptk, pelaku diberi pembinaan selama 3 bulan di salah satu Panti Pelayanan Sosial di Pontianak.
