<![CDATA[This study aims to analyze regulations regarding pretrial as an effort to enhance legal protection and fulfillment of the rights of suspects in Indonesia through the pretrial process in order to achieve human rights. Conducting an inventory and collection with a number of laws and regulations related to the related problems, the authors learn that legal protection of suspects' rights through pretrial efforts can be fulfilled by complying with statutory regulations relating to pretrial. However, it was found that to fulfill the legal protection of the suspect's rights still face several obstacles. The author argues that these obstacles are due to the passive action of the judges and the imprecision in the pretrial implementation. Â ABSTRAK Penelitian ini bertujuan untuk menganalisis peraturan mengenai praperadilan dalam upaya perlindungan hukum terhadap hak tersangka di Indonesia berikut pemenuhan hak tersangka melalui proses praperadilan demi tercapainya hak tersangka sebagai bagian dari pemenuhan hak asasi manusia. Dengan menginventarisir sejumlah peraturan perundang-undangan terkait masalah yang dikaji, penulis mempelajari bahwa perlindungan hukum terhadap hak tersangka melalui upaya praperadilan dapat dipenuhi dengan mematuhi peraturan perundang-undangan yang berkaitan dengan praperadilan. Namun, ditemukan bahwa untuk memenuhi perlindungan hukum terhadap hak tersangka tersebut masih terdapat beberapa hambatan. Penulis berargumen bahwa hambatan hambatan tersebut di antaranya disebabkan karena hakim yang bersifat pasif dan ketidaktepatan waktu pelaksanaan praperadilan.]]>
