<![CDATA[Abstrak – Adapun tujuan penulisan ini yaitu untuk mengetahui pengaturan presidential threshold dalam Undang-Undang Nomor 7 Tahun 2017 sudah sesuai dengan hak asasi manusia dan implikasi penerapan presidential threshold terhadap hak politik warga negara dan partai politik. Penggunaan metode penelitian yuridis normatif yakni penelitian hukum berupa pengkajian peraturan perundang-undangan. Hasil penelitian menunjukkan bahwasanya pengaturan ambang batas pencalonan Presiden dalam pandangan hak asasi manusia terlihat belum sejalan dengan amanat konstitusi, karena setiap orang berhak memiliki kesempatan yang sama untuk menduduki jabatan dalam pemerintahan, termasuk hak memilih dan dipilih. Mengenai implikasi dari kebijakan ambang batas Presiden ini berpeluang mereduksi hak warga negara khususnya hak politik, juga menghambat hak-hak partai politik kecil yang relatif rendah suara di parlemen, bahkan seperti partai baru saja yang telah sah diumumkan oleh Komisi Pemilihan Umum sebagai peserta pemilu juga mengalami hambatan dalam mengusung calon Presiden pada pemilu sebelumnya.Kata Kunci : Presidential threshold, Pemilihan umum Abstract - The purpose of this writing is to find out the presidential threshold arrangement in Law Number 7 Year 2017 is in accordance with human rights and the implications of the application of the presidential threshold on the political rights of citizens and political parties. The use of normative juridical research methods is legal research in the form of an assessment of laws and regulations. The results of the study show the setting of the presidential nomination threshold in the view of human rights does not seem to be in line with the constitutional mandate, because everyone has the right to have the same opportunity to occupy positions in government, including the right to vote and be elected. Regarding the implications of the presidential threshold policy, it is likely tto reduce the rights of citizens, especially political rights, as well as hinder the rights of small political parties that have relatively low votes in parliament, even as new parties that has been legally announced by the Election Commission as election participants have also experienced obstacles in carrying presidential candidates in previous elections.Keywords : Presidential threshold, Pemilihan umum]]>
