Tinjauan Hukum Islam dan UU tentang Wakaf terhadap Pencatatan Tanah Wakaf Produktif

Abstract. The existence of waqf that is not administratively registered has the potential to cause disputes and lawsuits from certain parties. This also happened to the waqf land area of 500m2 which is managed productively by the Hikmatus Sunnah Islamic Boarding School, East Palu City, which until now does not have the legality of formal waqf recording documents. Therefore, this research is focused on examining the recording of waqf which is managed productively by the Hikmatus Sunnah Islamic Boarding School in East Palu City. The research method used in this study is an analytical description with a normative juridical approach to examine the implementation of unrecorded waqf management from the perspective of Islamic law and Law No. 41 of 2004 concerning Waqf. The results show that the recording of productive waqf at the Hikmatus Sunnah Islamic Boarding School in East Palu City has not fully fulfilled the pillars and requirements of waqf according to Islamic law, namely that they do not have strong legal evidence in the form of a Waqf Pledge Deed. Then the recording of waqf in the management of productive waqf at the Hikmatus Sunnah Islamic Boarding School in East Palu City according to Law Number 41 of 2004 concerning Waqf in general is not contradictory, but for orderly administration and the nadzir should communicate with the Wakif heirs so that the Waqf Pledge Deed is immediately issued in in front of the PPAIW KUA officer of East Palu District. Abstrak. Adanya wakaf yang tidak tercatat secara administratif berpotensi menimbulkan sengketa dan gugatan dari pihak-pihak tertentu. Hal ini pun terjadi pada lahan wakaf seluas 500m2 yang dikelola secara produktif oleh Pesantren Hikmatus Sunnah Kota Palu Timur yang sampai saat ini belum memiliki legalitas dokumen pencatatan wakaf secara formal. Oleh karena itu, penelitian difokuskan untuk mengkaji pencatatan wakaf yang dikelola secara produktif oleh pihak Pesantren Hikmatus Sunnah Kota Palu Timur. Metode penelitian yang digunakan dalam penelitian ini adalah deskripsi analitis dengan pendekatan yuridis normatif untuk meneliti pelaksanaan pengelolaan wakaf yang belum tercatat dari perspektif hukum Islam dan UU No 41 Tahun 2004 Tentang Wakaf. Hasil penelitian menunjukkan bahwa pencatatan wakaf produktif di Pondok Pesantren Hikmatus Sunnah Kota Palu Timur belum sepenuhnya memenuhi rukun dan syarat wakaf menurut hukum Islam yaitu belum memiliki bukti hukum yang kuat berupa Akta Ikrar Wakaf. Kemudian pencatatan wakaf dalam pengelolaan wakaf produktif di Pondok Pesantren Hikmatus Sunnah Kota Palu Timur menurut UU Nomor 41 Tahun 2004 Tentang Wakaf secara umum tidak bertentangan, tetapi untuk tertib administrasi dan pihak nadzir sebaiknya melakukan komunikasi dengan pihak ahli waris Wakif agar segera diterbitkan Akta Ikrar Wakaf di depan petugas PPAIW KUA Kecamaran Palu Timur.
