PENGATURAN BUYBACK SAHAM DALAM AKTIVITAS INVESTASI EQUITY CROWDFUNDING PADA PLATFORM LANDX

Tujuan penulisan artikel ini ialah untuk menganalisis pengaturan buyback saham dalam aktivitas investasi equity crowdfunding pada platform Landx. Penulisan artikel ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan konsep, dan pendekatan analitis. Hasil penelitian menunjukkan bahwa pengaturan buyback saham dalam investasi equity crowdfunding pada platform Landx belum diatur secara jelas dalam POJK 57 Tahun 2020. Buyback saham investasi equity crowdfunding pada platform LandX merupakan kebijakan dari platform LandX sebagai penyelenggara yang dapat terjadi atas kesepakatan para pihak yaitu perusahaan penerbit dengan pemodal yang dituangkan dalam suatu perjanjian. Kemudian, akibat hukum atas adanya perjanjian buyback saham dalam investasi equity crowdfunding pada platform LandX ialah para pihak wajib untuk memenuhi prestasinya yaitu perusahaan penerbit berkewajiban untuk membeli saham pemodal kembali dan pemodal berkewajiban untuk menjual saham yang dimilikinya seusai dengan waktu yang telah disepakati dalam perjanjian dalam akitvitas investasi equity crowdfunding pada platform LandX. The purpose of this article is to analyze stock buyback arrangements in equity crowdfunding investment activities on the Landx platform. This article uses normative legal research methods with statutory approaches, conceptual approaches, and analytical approaches. The results of the study show that the regulation of stock buybacks in equity crowdfunding investments on the Landx platform has not been clearly regulated in POJK 57 of 2020. The buyback of equity crowdfunding investment stock on the LandX platform is a policy of the LandX platform as the organizer which can occur by agreement of the parties, namely the issuing company with investors as stated in an agreement. Then, the legal consequence of the existence of a stock buyback agreement in equity crowdfunding investment on the LandX platform is that the parties are obliged to fulfill their achievements, namely the issuing company is obliged to buy back the investor's shares and the investor is obliged to sell the stock they own after the time agreed in the agreement in the activity crowdfunding equity investments on the LandX platform.
