ANALISIS JUAL BELI EMAS DENGAN MENGGUNAKAN MEDIA ELEKTRONIK BERDASARKAN PERSPEKTIF HUKUM ISLAM

Abstract

AbstractThe development of the era related to buying and selling, especially buying and selling of gold through electronic media with a payment system in advance, then the goods will arrive a few days later. Meanwhile, gold is a ribawi item that must be hand-to-hand in buying and selling. Some scholars say that gold is included in ribawi goods (amwalribawiyah) which have the potential for usury in it. Therefore, this study aims to analyze the legal transactions of buying and selling gold electronically in terms of Islamic law, analyzing the views of scholars on buying and selling gold through electronic media, analyzing the consequences of buying and selling gold electronically which contains elements of usury. By using this type of normative legal research with a case approach, a conceptual approach, the results of research on gold buying and selling transactions carried out through electronic media according to Islamic law, are not in accordance with Shari'a because Islamic law requires the presence of goods used as as the object of sale and purchase in the contract and must be passed from hand to hand. Regarding the views of the Ulama and MUI (Indonesian Ulema Council) of West Kalimantan Province regarding the sale and purchase of gold through electronic media, they have different opinions. The scholars agree that buying and selling gold must be on cash terms, but they differ on the time limit. Imam Hambali and Imam Syafi'i are of the opinion that buying and selling currency occurs in cash as long as the two parties have not separated, whether the recipient is at the time of the transaction or the receipt is late. But Imam Maliki is of the opinion that if the acceptance at the assembly is late, then the sale and purchase is cancelled, even though the two parties have not parted ways. Meanwhile, in the opinion of the MUI of West Kalimantan Province regarding the sale and purchase of gold through electronic media, the law is permissible as long as it fulfills the pillars and conditions for legal sale and does not contain gharar. as a result of buying and selling gold electronically which according to the views of classical scholars is unlawful and the danger of usury is very large which threatens the afterlife of a muslimKeywords: Gold Buying and Selling, Electronic Media, Islamic Law   AbstrakBerkembangnya zaman terkait jual beli khususnya jual beli emas melalui media elektronik dengan sistem bayar terlebih dahulu lalu barangnya akan datang beberapa hari kemudian. Sedangkan emas merupakan barang ribawi yang dalam jual belinya harus dari tangan ke tangan, Beberapa kalangan ulama menyebutkan bahwa emas termasuk ke dalam barang ribawi (amwalribawiyah) yang berpotensi riba di dalamnya. Oleh karena itu, penelitian ini bertujuan  untuk menganalisis hukum transaksi jual beli emas secara elektronik ditinjau dari hukum Islam, menganalisis pandangan ulama terhadap jual beli emas melalui media elektronik, menganalisis akibat dari jual beli emas secara eletronik yang mengandung unsur riba. Dengan menggunakan jenis penelitian hukum normatif dengan pendekatan kasus (case approach), pendekatan konseptual (conseptual approach), hasil penelitian transaksi jual beli emas yang dilakukan melalui media elektronik menurut Hukum Islam, tidak sesuai syari’at karena dalam hukum Islam mengharuskan hadirnya barang yang dijadikan sebagai objek jual beli dalam akadnya dan harus dari tangan ke tangan. Terkait pandangan ulama dan MUI (Majelis Ulama Indonesia) Provinsi Kalimantan Barat terkait jual beli emas melalui media elektronik mereka berbeda pendapat, para ulama sepakat bahwa jual beli emas harus dengan syarat tunai, tetapi mereka berbeda pendapat tentang waktu yang membatasi. Imam Hambali dan Imam Syafi'i berpendapat bahwa jual beli mata uang terjadi secara tunai selama kedua belah pihak belum berpisah, baik penerimanya pada saat transaksi atau penerimaannya terlambat. Tetapi Imam Maliki berpendapat jika penerimaan pada majelis terlambat, maka jual beli tersebut batal, meski kedua belah pihak belum berpisah. Sedangkan, menurut pendapat MUI Provinsi Kalimantan Barat tentang jual beli emas melalui media elektronik hukumnya adalah boleh selama masih memenuhi rukun dan syarat sah jual dan tidak mengandung gharar. akibat dari jual beli emas secara elektronik yang menurut pandangan ulama klasik adalah haram hukumnya dan bahaya riba sangat besar yang mengancam kehidupan akhirat seorang muslim Kata Kunci: Jual Beli Emas, Media Elektronik, Hukum Islam
