Perlindungan Hak Pekerja PKWT Dalam Pemutusan Hubungan Kerja Berdasarkan Dari Ketentuan Hukum Ketenagakerjaan

Abstract

The problem of worker status in Indonesia is getting worse with the legalization of the practice of Fixed Term Agreements with Law Number 11 of 2020 concerning Employment, which has caused a lot of controversy. Amidst public concerns about the rebirth of the dangers of capitalism, the government has actually legalized the practice of PKWT / work contracts that can be continuously extended, which are economically and morally detrimental to workers/laborers. The formulation of the problem in this writing is how legal protection for PKWT workers who are laid off is linked to the Employment Law. The method used in this research is normative juridical research in the form of library legal materials or secondary data with primary, secondary and tertiary sources of legal materials. The research approach used is statutory, conceptual, analytical and case approaches as well as legal material analysis techniques carried out using systematic and grammatical legal interpretation. The research results show that legal protection for PKWT workers who are laid off is linked to the Employment Law, namely as stipulated in Law Number 2 of 2004 for the resolution of Industrial Relations Disputes. If an industrial relations dispute occurs, it can be resolved in 2 ways, namely through litigation (court) or through non-litigation (outside court). The litigation route generally starts from the industrial relations court at the District Court at the Supreme Court level. Meanwhile, in the non-litigation route, parties can resolve industrial relations disputes by means of arbitration, conciliation, bipartite and mediation. ABSTRAK Problema status pekerja di Indonesia semakin parah seiring dilegalkannya praktik Perjanjian Waktu Tertentu dengan Undang Nomor 11 Tahun 2020 Tentang Ketenagakerjaan yang banyak menuai kontroversi itu. Ditengah kekhawatiran masyarakat akan lahirnya kembali bahaya kapitalisme, pemerintah justru melegalkan praktik PKWT / Kontrak Kerja yang dapat terus diperpanjang yang secara ekonomi dan moral merugikan pekerja/buruh. Adapun rumusan masalah dalam penulisan ini yaitu bagaimana perlindungan hukum bagi Tenaga Kerja PKWT yang di PHK dikaitkan dengan Undang-undang Ketenagakerjaan. Metode yang digunakan dalam penelitian ini dengan jenis penelitian yuridis normatif berupa bahan hukum kepustakaan atau data sekunder dengan sumber bahan-bahan hukum primer, sekunder dan tersier. Adapun pendekatan penelitian yang dipergunakan pendekatan perundang-undangan, konseptual, analitis dan kasus serta teknik analisa bahan hukum dilakukan dengan penafsiran hukum sistematis dan gramatikal. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi Tenaga Kerja PKWT yang di PHK dikaitkan dengan Undang-undang Ketenagakerjaan yaitu sebagaimana ketentuan Undang-undang Nomor 2 Tahun 2004 penyelesaian Perselisihan Hubungan Industrial. Jika terjadi perselisihan hubungan industrial maka dapat diselesaikan dengan 2 cara, yaitu melalui jalur litigasi (pengadilan) ataupun melalui jalur non litigasi (di luar pengadilan). Pada jalur litigasi umumnya dimulai dari pengadilan hubungan industrial pada Pengadilan Negeri pada tingkat Mahkamah Agung. Sedangkan pada jalur non litigasi para pihak dapat menyelesaikan perselisihan hubungan industrial dengan cara arbitrase, konsiliasi, bipartit, dan mediasi.
