Abstract

This study explores aspects of labor governance relations in the field of work relations at the Tebuireng Islamic boarding school. Considering that this pesantren has many units, it contains many employees, especially employees who are contracted as teachers (educators). The purpose of this study was to determine the legal review of employment in Pondok Pesantren Tebuireng Jombang, East Java. This study uses a qualitative research method with a sociological juridical approach. While the data collection techniques in the study used several stages, including; First, the library (Library Research). Second, Observation, Third, Interview, and Fourth, documentation. Data analysis with data reduction steps, data presentation and drawing conclusions The results of this study indicate that in general the implementation of labor governance at the Tebuireng Islamic Boarding School is in accordance with the applicable rules, namely with a work contract, work agreements have been regulated in governance rules. staff in Islamic boarding schools.

Abstract

Abstract: Basically, drug crimes are real and exist around our lives. Therefore, every individual in society must be vigilant and declare war on drugs. Many modus operandi is carried out by perpetrators and drug crime syndicates to deceive law enforcement officials. In addition, the motives of the perpetrators cannot be underestimated or only because of economic factors or just looking for profit, but it is possible that there are other indications. We can see that the perpetrators continue to be arrested, but the circulation of drugs continues to occur with various new modus operandi and seems to be unstoppable. This is certainly a shared thought and a material for reflection for the Indonesian people to rise up against drugs. Abstrak: Pada dasarnya kejahatan narkoba itu adalah nyata adanya dan ada disekitar kehidupan kita. Oleh karenanya setiap individu masyarakat harus waspada dan menyatakan perang melawan narkoba. Banyak modus operandi dilakukan oleh para pelaku dan sindikat kejahatan narkoba untuk mengelabui apparat penegak hukum. Selain itu motif para pelaku, juga tidak bisa dipandang sebelah mata atau hanya sekedar karena faktor ekonomi ataupun hanya sekedar mencari keuntungan, tetapi tidak menutup kemungkinan ada indikasi lain. Kita bisa melihat pelaku terus dilakukan penangkapan, namun peredaran narkoba terus saja terjadi dengan berbagai modus operandi baru dan seolah-olah tidak terbendung lagi. Ini tentunya menjadi pemikiran bersama dan sebagai bahan renungan bagi masyarakat Indonesia untuk bangkit melawan narkoba

Abstract

Human rights are natural rights inherent in every human being. In the classical human rights paradigm, the state is considered the main actor carrying out obligations to fulfill human rights as stated in the International Covenant on Civil and Political Rights (ICCPR) and the International Covenant on Economic, Social, and Cultural Rights (ICESCR). However, with the emergence of factsregarding the impact of the company’s presence in a number of human rights violations, both domestic and multinational, there has been a discourse on the importance of non-state actors to be drawn as stakeholders in the human rights regime through the UNGP Principles in 2011. Agrarian conflicts as a result of the presence of oil palm plantations become a separate problem for business entities in the fulfillment of human rights, especially ESC rights, as a manifestation of the implementation of social and environmental responsibility norms. The method used in this research is normative legal research with a statute approach and a conceptual approach. This study aims to provide a juridical understanding that oil palm plantations as non-state actors also carry out obligations in fulfilling human rights.

Abstract

Kemajaun teknologi telah menggeser kebiasaan masyarakat global, termasuk cara masyarakat mengakses sebuah informasi berita yang kini dengan mudah dapat dilakukan kapanpun secara daring. Hal ini membuat banyak pers memuat hasil jurnalistiknya kedalam media digital yang siapapun bisa mengakses, membaca, bahkan mengcopynya, termasuk yang dilakukan oleh Aggregator berita. Kini aggregator berita lebih diminati oleh pembaca lantaran adanya penyederhanaan informasi yang disajikan, singkat dan hanya pada poin-poin pentingnya saja. Jenis, kategori hingga cakupan berita dapat disesuaikan (sort) dan dibatasi (filter) sesuai keinginan. Hal ini membuat konten aggregator berita lebih digemari masyarakat dibandingkan portal berita yang dibuat langsung oleh para pers, sehingga aggregator berita dianggap telah melanggar hak cipta. Penelitian tentang perlindungan hak cipta berita terhadap pengumpul berita atau anggregator berita ini dilakukan dengan pendekatan normatif, yakni pendekatan terhadap perundang-undangan, konseptual, dan kasus yang berhubungan dengan penelitian ini. Metode yang digunakan adalah library research, atau penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka hukum sebagai bahan primer. Adapun hasil dari penelitian ini adalah aggregator berita telah melanggar hak cipta yang diatur oleh UU Hak Cipta Nomor 28 tahun 2014, meski aggregator berita telah mencantumkan sumber berita dalam konten yang ia kutip, akan tetapi keuntungan ekonomi dari hasil publikasi berita oleh aggregator berita, telah melanggar hak ekonomi dari pencipta berita itu sendiri. Sehingga aggregator berita daring dalam praktiknya adalah melanggar hukum. Diperlukan kesadaran dari berbagai pihak agar tidak terjadi kerugian akibat dari kemajuan teknologi, khususnya dalam proses publikasi berita oleh aplikasi pengumpul berita (aggregator) yang kian marak.

Abstract

This research analyses how the Animal, Fish, and Plant Quarantine Law currently regulates quarantine and its institutions in positive law, the form and position of government institutions referred to in the Indonesian constitutional structure, and the direction of the government’s institutional arrangements is linked to Article 8 of the Quarantine Law. Animals, Fish and Plants in the Indonesian constitutional structure. Therefore, the form of government institution in the quarantine sector based on Article 8 of the Animal, Fish, and Plant Quarantine Law which is in accordance with the Indonesian legal system and constitutional structure is a Government Institution at the Ministry Level, considering the biosecurity function carried out in the implementation of quarantine. This normative legal research is supported by secondary data and analyzed qualitatively. From the results of the research, the government still needs to follow up on the regulation of animal, fish and plant quarantine and its institutions in the Animal, Fish and Plant Quarantine Law by drafting a Government Regulation Draft.

Abstract

Artikel ini membahas mengenai sebuah asas yang berkembang dalam hukum perjanjian internasional ialah asas rebus sic stantibus sebuah asas hukum yang menyatakan bahwa suatu perjanjian tidak lagi berlaku akibat keadaan yang mendasar, asas ini sebagai alat fundamental dalam mengantisipasi keadaan memaksa atau force majeure khususnya dalam keadaan pandemi covid-19 saat ini. dengan metode penelitian kepustakaan berdasarkan pendekatan penelitian normatif. tujuan penelitian ini sebagai sarana menemukan prinsip-prinsip pembaharuan hukum dengan mencari kedudukan hukum dan serta penerapannya dalam kerangka teori hukum keperdataan di Indonesia. berdasarkan hasil pembahasan dari tulisan ini bahwa asas rebus sic stantibus mempunyai peran dalam melakukan restrukturisasi suatu perjanjian dengan perjanjian baru dengan mengedepankan prinsip keberlanjutan dalam suatu perjanjian dan para pihak bisa melanjutkan kerja samanya.

Abstract

The primary aim of this research is to investigate the impact of the physical work environment, leadership, and work motivation on employee job satisfaction, and subsequently, how this affects staff performance at PT. Graha Prima Electrical Ambassador in Jakarta. The physical work environment, leadership, and job motivation are significant factors in an organisational setting that can have a considerable influence on the well-being and performance of employees. The current investigation will utilise quantitative research approaches. The study sample encompasses the entirety of the population, which is composed of a total of 35 employees. Nevertheless, the scope of the sample is restricted to those who are directly engaged in marketing activities, with the intention of enhancing the research results. The study's results suggest that there exists a strong and positive correlation between several aspects, such as the physical work environment, leadership, and work motivation, and the level of job satisfaction experienced by employees. The three independent factors have a substantial influence on the dependent variable, explaining 51.3% of its variability. The present study provides evidence that job satisfaction at PT Duta Listrik Graha Prima in Jakarta is influenced by various elements, including physical work environment characteristics, leadership style, and work motivation. These factors, in turn, have an impact on employee performance.

Abstract

The problem of worker status in Indonesia is getting worse with the legalization of the practice of Fixed Term Agreements with Law Number 11 of 2020 concerning Employment, which has caused a lot of controversy. Amidst public concerns about the rebirth of the dangers of capitalism, the government has actually legalized the practice of PKWT / work contracts that can be continuously extended, which are economically and morally detrimental to workers/laborers. The formulation of the problem in this writing is how legal protection for PKWT workers who are laid off is linked to the Employment Law. The method used in this research is normative juridical research in the form of library legal materials or secondary data with primary, secondary and tertiary sources of legal materials. The research approach used is statutory, conceptual, analytical and case approaches as well as legal material analysis techniques carried out using systematic and grammatical legal interpretation. The research results show that legal protection for PKWT workers who are laid off is linked to the Employment Law, namely as stipulated in Law Number 2 of 2004 for the resolution of Industrial Relations Disputes. If an industrial relations dispute occurs, it can be resolved in 2 ways, namely through litigation (court) or through non-litigation (outside court). The litigation route generally starts from the industrial relations court at the District Court at the Supreme Court level. Meanwhile, in the non-litigation route, parties can resolve industrial relations disputes by means of arbitration, conciliation, bipartite and mediation. ABSTRAK Problema status pekerja di Indonesia semakin parah seiring dilegalkannya praktik Perjanjian Waktu Tertentu dengan Undang Nomor 11 Tahun 2020 Tentang Ketenagakerjaan yang banyak menuai kontroversi itu. Ditengah kekhawatiran masyarakat akan lahirnya kembali bahaya kapitalisme, pemerintah justru melegalkan praktik PKWT / Kontrak Kerja yang dapat terus diperpanjang yang secara ekonomi dan moral merugikan pekerja/buruh. Adapun rumusan masalah dalam penulisan ini yaitu bagaimana perlindungan hukum bagi Tenaga Kerja PKWT yang di PHK dikaitkan dengan Undang-undang Ketenagakerjaan. Metode yang digunakan dalam penelitian ini dengan jenis penelitian yuridis normatif berupa bahan hukum kepustakaan atau data sekunder dengan sumber bahan-bahan hukum primer, sekunder dan tersier. Adapun pendekatan penelitian yang dipergunakan pendekatan perundang-undangan, konseptual, analitis dan kasus serta teknik analisa bahan hukum dilakukan dengan penafsiran hukum sistematis dan gramatikal. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi Tenaga Kerja PKWT yang di PHK dikaitkan dengan Undang-undang Ketenagakerjaan yaitu sebagaimana ketentuan Undang-undang Nomor 2 Tahun 2004 penyelesaian Perselisihan Hubungan Industrial. Jika terjadi perselisihan hubungan industrial maka dapat diselesaikan dengan 2 cara, yaitu melalui jalur litigasi (pengadilan) ataupun melalui jalur non litigasi (di luar pengadilan). Pada jalur litigasi umumnya dimulai dari pengadilan hubungan industrial pada Pengadilan Negeri pada tingkat Mahkamah Agung. Sedangkan pada jalur non litigasi para pihak dapat menyelesaikan perselisihan hubungan industrial dengan cara arbitrase, konsiliasi, bipartit, dan mediasi.

Abstract

The Indonesian government has established various institutions as an effort to protect human rights and justice for women and children, including the National Commission on Violence Against Women, the National Commission on Human Rights, the Witness and Victim Protection Agency and the Ombudsman. Even though Indonesia has ratified the CEDAW Convention plus strengthened through various human rights institutions, violence against women and children is still massive in Indonesia. In this writing, the research method used by the author is normative juridical. The results of this study show that violence against women and children will continue to occur if the government is not really serious in making regulations and implementing the protection of women and children. Apart from that, public awareness is needed regarding the nature of being human, that all human beings are equal. Abstrak       Pemerintah indonesia telah membentuk berbagai institusi sebagai upanya perlindungan HAM dan keadilan terhadap kaum perempuan dan anak, diantaranya Komnas Perempuan, Komnas HAM, Lembaga Perlindungan Saksi dan Korban dan, Ombudsman. Meski indonesia telah meratifikasi Konvensi CEDAW ditambah penguatan melalui berbagai lembaga HAM, kekerasan terhadap perempuan dan anak masih masif terjadi di Negara Indonesia. Dalam penulisan ini , metode penelitian yang digunakan oleh penulis adalah normatif yuridis. Adapun hasil penelitian ini bahwa kekerasan terhadap perempuan dan anak akan terus terjadi apabila pemerintah tidak benar-benar serius dalam membuat regulasi dan implementasi terhadap perlindungan perempuan dan anak, selain daripada itu dibutuhkan kesadaran masyarakat terkait hakikat menjadi manusia bahwa semua manusia itu sama kedudukannya.
