PERLINDUNGAN KONSUMEN TERHADAP TINDAK PIDANA PEMALSUAN OBAT

AbstrakTindakan pidana pemalsuan obat semakin merajalela, disebabkan karena penanggulangantindakan pemalsuan obat belum dikoordinasikan secara sistematis, sehingga penindakanterhadap kasus pemalsuan dan peredaran obat palsu belum berjalan dengan baik. Perandan tanggung jawab pemerintah dalam peredaran obat-obatan palsu yang mengakibatkankerugian bagi konsumen, secara hukum tindakan tersebut disebabkan unsur kesalahanatau perbuatan melanggar hukum yang dilakukan oleh pelaku usaha. Untuk melindungikonsumen, obat-obat yang telah exipired harus ditarik untuk dimusnahkan, dan tidakboleh dijual kembali dengan label atau diolah kembali menjadi obat yang lain sepertijamu atau suplemen tertentu. Adapun Kajian permasalahan ini bagaimanakah upayaperlindungan hukum terhadap konsumen tindak pidana pemalsuan produksi obat?.Bagaimanakah Alur Proses Pengaduan Korban Terhadap Tindak Pidana PemalsuanProduksi Obat?. Menurut Satijipto Raharjo, perlindungan hukum adalah memberikanpengayoman terhadap hak asasi manusia (HAM) yang dirugikan orang lain danperlindungan itu di berikan kepada masyarakat agar dapat menikmati semua hak-hakyangdiberikan oleh hukum. Perlindungan hukum terhadap konsumen tindak pidanapemalsuan produksi obat, melalui Badan POM sebagai perlindungan terhadap konsumenagar tidak membahayakan konsumen yang mengkonsumsi obat-obatan yang diedarkan.Pengawasan Badan POM harus dilakukan untuk pengecekan produksi obat yang beredarserta peranan perlindungan konsumen atas tindak pidana pemalsuan produksi obat dapatdilindungi oleh pemerintah. Pelaku atas perbuatan tindak pidana pemalsuan produksi obatdapat dihukum melalui ancaman hukuman dalam ketentuan udang-undang perlindungankonsumen. Aturan-aturan hukum guna melindungi masyarakat, dari perbuatan tindakpidana pemalsuan produksi obat.Kata Kunci : Perlindungan Hukum, Konsumen, Pemalsuan Obat.AbstractCriminal acts of drug counterfeiting are increasingly rampant, due to the fact thatcountermeasures against drug counterfeiting have not been systematically coordinated,so that the prosecution of counterfeit cases and the circulation of counterfeit drugs hasnot gone well. The role and responsibility of the government in the distribution ofcounterfeit drugs that result in losses for consumers, legally these actions are caused byseveral mistakes or unlawful acts committed by business actors. To protect consumers,medicines that have expired must be recalled for destruction, and may not be resold undera label or reprocessed into other medicines such as certain herbs or supplements.Regarding the study of this problem, what are the efforts to protect the law against consumers for the criminal act of counterfeiting drug production? What is the flow of thevictim's complaint process against the crime of counterfeiting drug production?According to Satijipto Raharjo, legal protection is providing protection for human rights(HAM) that are harmed by other people and this protection is given to the community sothat they can enjoy all the rights granted by law. Legal protection for consumers againstthe criminal act of counterfeiting drug production, through the BPOM as protection forconsumers so as not to endanger consumers who consume dead drugs. BPOMsupervision must be carried out to check drug production in circulation and the role ofconsumer protection for the crime of counterfeiting drug production can be protected bythe government. Perpetrators of criminal acts of counterfeiting drug production can bepunished through threats in the provisions of the consumer protection law. Legal rules toprotect the public from criminal acts of drug production counterfeiting.Keywords: Legal Protection, Consumers, Drug Counterfeiting.
