<![CDATA[AbstrakKeberadaan Undang-Undang Nomor 5 Tahun 1999 dan KPPU nampaknya kurang memberi efek jera pada pelaku usaha. Persaingan usaha yang sehat dalam tender jelas bisa diartikan dengan adanya usaha untuk menunjukan kemapuan masing-masing dari perusahaan secara mandiri dalam penawaran dan pemenuhan persyaratan tanpa bergantung dengan penyelenggara tender itu sendiri. Undang-Undang anti Monopoli jelas dibentuk untuk menghindari tindakan-tindakan dari kelompok yang menguasai pasar. Berdasarkan Putusan KPPU dengan perkara nomor 35/KPPU-I/2020 tentang persekongkolan tender maka penulis menyimpulkan bahwa putusan tersebut sudah sesuai dengan Pasal 22 Undang-Undang no 5 tahun 1996 dimana dalam perkara tersebut Majelis Komisi meyakinkan telah terpenuhinya unsur-unsur persekongkolan tender yaitu Unsur Pelaku Usaha, Unsur Pelaku Usaha Lain dan/atau Pihak yang terkait dengan Pelaku Usaha Lain,Unsur Bersekongkoluntuk Mengatur atau Menentukan Pemenang Tender, Unsur Dapat Mengakibatkan Terjadinya Persaingan Usaha Tidak Sehat.Kata Kuci: UU No. 5 thn 1999, KPPU, Anti MonopoliAbstractThe existence of Law Number 5 Year 1999 and KPPU seem to have less of a deterrent effect on business actors. Fair business competition in tenders can clearly be interpreted as efforts to show the ability of each company independently in bidding and fulfilling requirements without relying on the organizer of the tender itself. The anti-monopoly law was clearly formed to prevent the actions of groups that control the market. Based on the KPPU's decision with case number 35/KPPU-I/2020 concerning tender conspiracy, the authors conclude that the decision is in accordance with Article 22 of Law No. 5 of 1996 where in this case the Commission Assembly is convinced that the elements of a tender conspiracy have been fulfilled, namely Business Actors, Elements of Other Business Actors and/or Parties related to Other Business Actors, Elements of Conspiracy to Arrange or Determine the Winner of a Tender, Elements Can Result in Unfair Business Competition.Keywords: UU no. 5 of 1999, KPPU, Anti Monopoly]]>
