Abstrack. Penelitian ini berfokus kepada pembuktian atas penetapan anak di luar perkawinan yang sah tanpa melalui tes DNA pada putusan Nomor 109/PDT/2022/PT BTN. Tujuan penelitian ini untuk mengetahui pertanggungjawaban ayah biologis kepada anak di luar perkawinan yang sah tanpa melalui tes DNA dan akibat hukumnya pada Putusan No. 109/PDT/2022/PT BTN ditinjau dari UU Perkawinan dan Putusan MK/46/PUU-VIII/2010. Metode penelitian ini menggunakan pendekatan kualitatif dan pendekatan undang-undang. Teknik pengumpulan data yang digunakan melalui studi pustaka dan dianalisis secara deskriptif kualitatif. Penelitian ini membuktikan bahwa pertanggungjawaban ayah biologis atas penetapan anak di luar perkawinan yang sah tanpa tes DNA ialah memelihara dan mendidik anak tersebut sebagaimana ketentuan Pasal 45 ayat (1) UU Perkawinan. Putusan MK No. 46/PUU-VIII/2010 juga menjadikan ayah biologis wajib bertanggung jawab akibat adanya hubungan keperdataan. Akibat hukum Putusan No. 109/PDT/2022/PT BTN yaitu RA wajib mengakui NKT sebagai anak kandungnya selama RA belum mampu menunjukkan sebaliknya. Pengakuan ini dapat dilakukan melalui akta-akta kelahiran NKT, akta yang dibuat oleh petugas catatan sipil dan dicatat dalam akta kelahiran NKT, serta akta otentik yang kemudian dicatat dalam akta kelahiran NKT sebagaimana Pasal 281 KUHPerdata. Abstract. This research focuses on proving the legal determination of children outside of marriage without going through a DNA test in decision Number 109/PDT/2022/PT BTN. The purpose of this research is to determine the responsibility of biological fathers to children outside of a legal marriage without going through a DNA test and the legal consequences in Decision No. 109/PDT/2022/PT BTN reviewed from the Marriage Law and Decision MK/46/PUU-VIII/2010. This research method uses a qualitative approach and a legal approach. The data collection technique used was through literature study and analyzed descriptively qualitatively. This research proves that the biological father's responsibility for determining a child out of wedlock as legal without a DNA test is to care for and educate the child as stipulated in Article 45 paragraph (1) of the Marriage Law. Constitutional Court Decision No. 46/PUU-VIII/2010 also makes biological fathers obliged to take responsibility due to civil relations. Legal consequences of Decision no. 109/PDT/2022/PT BTN, namely that RA is obliged to recognize NKT as his biological child as long as RA is unable to show otherwise. This recognition can be done through NKT birth certificates, deeds made by civil registration officers and recorded in the NKT birth certificate, as well as authentic deeds which are then recorded in the NKT birth certificate as stated in Article 281 of the Civil Code.
