<![CDATA[Tujuan dari penelitian ini untuk menganalisis perlindungan hukum terhadap korban tindak pidana KBGO serta mengidentifikasi materi muatan UU TPKS telah mengatur mengenai KBGO dalam perspektif UU TPKS sebagai wujud realisasi dan harmonisasi hukum dengan Pasal 28D Ayat (1) UUDNRI 1945. Metode penelitian hukum yang digunakan yakni yuridis normatif dengan pendekatan konseptual dan peraturan perundang-undangan. Realisasi Pasal 28G Ayat (2) konstitusi dalam aspek KBGO telah termuat dalam UU TPKS. Materi muatan UU TPKS dinyatakan tidak menyimpang dari konstitusi berdasar pada Pasal 28G Ayat (2) konstitusi. Harmonisasi belum terdapat antara kedua peraturan tersebut karena belum memberikan jaminan kepastian hukum layaknya Pasal 28D Ayat (1). Amanat konstitusi jaminan perlindungan korban belum direalisasikan pada UU TPKS ini agar tidak terjadi disharmonisasi. The purpose of this study is to analyze the legal protection of victims of KBGO crimes and identify the content material of the TPKS Law that has regulated KBGO in the perspective of the TPKS Law as a form of legal realization and harmonization with Article 28D Paragraph (1) of the 1945 Constitution. The legal research method used is normative juridical with a conceptual approach and legislation. The realization of Article 28G Paragraph (2) of the constitution in the aspect of KBGO has been contained in the TPKS Law. The content material of the TPKS Law is declared not to deviate from the constitution based on Article 28G Paragraph (2) of the constitution. Harmonization does not yet exist between the two regulations because it does not provide a guarantee of legal certainty like Article 28D Paragraph (1). The constitutional mandate to guarantee victim protection has not been realized in the TPKS Law to avoid disharmony.]]>
