Abstract

as regulated in Article 61 of the Presidential Regulation of the Republic of Indonesia Number 71 of 2012 concerning the Implementation of Land Acquisition for Development in the Public Interest. However, in this case, the Plaintiff as the party who has the right does not use legal remedies in the provisions mentioned above, so the Plaintiff is deemed to have accepted the decision of the land procurement committee by law. So this matter cannot be said to be an unlawful act, because there has been no rejection of the Plaintiff's objection to the results of the Inventory and Identification of Land Acquisition for the Medan - Binjai Toll Road Section I Clearance Project. As explained in the explanation above, the unlawful act committed by Defendants I, II and III regarding violating the law was wrong, because the Plaintiff had not yet held a deliberation regarding his objection, where it was clear that the implementation of land acquisition for development was in the public interest, objections to the results of the inventory and identification were rejected, the Chief Executive of Land Procurement made minutes of rejection. However, in this case no objection has ever been raised by the Plaintiff.

Abstract

The existence of human rights guarantees and affirmative action concerning the right to work is contained in Undang-Undang Dasar 1945 as theconstitution of Republic Indonesia. The aim of this research is for understanding about constitutive regulation concerning the rights to work for persons with disability after the Law number 11 of 2020 Concerning Job Creation in Indonesia. This issue is then analyzed using a normative method with an approach to aspects of legislation and a conceptual approach to the issue of constitutive regulations fulfilling the rights to employment and employment of Persons with Disabilities after Law Number 11 of 2020 concerning Job Creation in Indonesia. As a result, the regulation does not significantly regulate the fulfillment of workers' rights in the employment of persons with disabilities, as well as the obligations of employers. Eksistensi jaminan hak asasi manusia dan affirmative action terkait dengan hak pekerjaan  dirumuskan secara konstitusional di dalam  Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Penelitian ini bertujuan untuk mengetahui pengaturan hak pekerjaan dan ketenagakerjaan penyandang disabilitas secara konstitutif pasca terbitnya Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja yang mengalami dinamika politik hukum. Isu tersebut kemudian dianalisis menggunakan metode normatif dengan pendekatan aspek peraturan perundang-undangan dan pendekatan konsep dengan isu peraturan konstitutif pemenuhan hak pekerjaan dan ketenagakerjaan Penyandang Disabilitas pasca Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja di Indonesia. Hasilnya, Pengaturan tidak signifikan mengatur pada pemenuhan hak pekerja pada ketenagakerjaan penyandang disabilitas, begitu juga kewajiban pemberi kerja.

Abstract

Cyber Flashing is a form of Online Gender-Based Violence (KBGO) which is carried out by perpetrators by sending pictures and/or video messages of genitals or things that have sexual content to other people without the consent of the recipient of the message. This study aims to explore Law no. 12 of 2022 concerning Crimes of Sexual Violence which at least can be a hope for victims to get justice and legal protection, one of which is by the threat of punishment as stated in Article 14. The authors in this study used a type of normative juridical research with a statutory, theoretical, and legal approach. and cases. The results of this study are that the legal protection that is obtained by victims of sexual violence, especially those that occur on social media such as Cyber ​​Flashing, cannot be carried out optimally because derivative regulations have not been issued and several obstacles make victims not dare to report them to the parties. the authorities which results in hampering efforts to enforce the law on acts of sexual violence.
