AbstracOnline buying and selling has made it easier for buyers to find goods and/or services, and sellers also get convenience in marketing their products, and can even save costs and time. Only by listing the brand or brand that will be marketed in visual form such as photos and videos to facilitate marketing distribution, the purpose of this study is to examine the form of legal protection for online Smartphones buying and selling in the TikTok Marketplace which has Black Market status. And how is the role of the government in handling cases of buying and selling smartphones with Black Market status in the TikTok Marketplace.This research method uses a type of normative legal research method (normative juridical). This research also uses a statutory approach. A statutory approach was taken to examine the statutory regulations governing consumer protection in buying and selling smartphones with black market status on the TikTok Marketplace contained in Law Number 8 of 1999 concerning Consumer Protection.From the results of this study, Article 8 paragraph 1 of the Consumer Protection Law states "Sales promotion advertisements and promises listed on the label do not match the goods and services." Moreover, if the goods sold are illegal or black market goods, this is very detrimental to the State and consumers. Consumers who feel disadvantaged by business actors can request their rights contained in Article 4 paragraph (8) of the Consumer Protection Law. The role of the government in handling cases of buying and selling smartphones with Black Market status, the Indonesian Government plays a crucial role in regulating and supervising electronic transactions, including in buying and selling smartphones, through agencies such as BRTI and Kominfo. Consumer protection in purchasing smartphones, especially in the Black Market market, involves joint responsibility between the government, business actors, marketplaces, and law enforcement agencies to create a safe and fair e-commerce environment.Keyword : Consumer Protection, Smartphones, Black Market, Marketplace Abstrak Jual beli online telah memberikan kemudahan bagi pembeli untuk mencari barang dan/atau jasa, dan penjual juga mendapatkan kemudahan dalam memasarkan produknya, bahkan dapat menghemat biaya dan waktu. Hanya dengan mencantumkan brand atau merek yang akan dipasarkan dalam bentuk visual seperti foto dan video untuk mempermudah penyebaran pemasaran, tujuan penelitian ini mengkaji bentuk perlindungan secara yuridis terhadap jual beli Smartphone secara online di Marketplace TikTok yang berstatus Black Market. Serta bagaimana peranan pemerintah dalam penanganan kasus jual beli smartphone berstatus Black Market di Marketplace TikTok.Metode penelitian ini menggunakan jenis metode penelitian hukum normatif (yuridis normatif). Penelitian ini juga menggunakan pendekatan Perundang "“ undangan (Statute Approach). Pendekatan perundang "“ undangan dilakukan untuk meneliti aturan perundang "“ undangan yang mengatur tentang perlindungan konsumen dalam jual beli smartphone bertstatus black market di Marketplace TikTok yang terdapat dalam Undang "“ undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen.Dari hasil penelitian ini Pasal 8 ayat 1 Undang-Undang Perlindungan Konsumen yang berbunyi "Iklan promosi penjualan serta janji yang dicantumkan dalam label tidak sesuai dengan barang dan jasa tersebut." Apalagi jika barang yang dijual merupakan barang illegal atau black market, ini sangat merugikan bagi Negara dan konsumen. Konsumen yang merasa dirugikan oleh pelaku usaha dapat meminta hak-haknya yang terdapat dalam Pasal 4 ayat (8) Undang-Undang Perlindungan Konsumen. Peran pemerintah dalam menangani kasus jual beli smartphone berstatus Black Market, Pemerintah Indonesia memainkan peran krusial dalam mengatur dan mengawasi transaksi elektronik, termasuk dalam jual beli smartphone, melalui badan seperti BRTI dan Kominfo. perlindungan konsumen dalam pembelian smartphone, terutama di pasar Black Market, melibatkan tanggung jawab bersama antara pemerintah, pelaku usaha, marketplace, dan lembaga penegak hukum untuk menciptakan lingkungan e-commerce yang aman dan adil.Kata Kunci : Perlindungan Konsumen, Jual Beli, Black Market, Marketplace
