ABSTRACT  One form of unlawful act committed by members of the public is selling adulterated liquor. This also happens in the Kubu Raya Regency area, especially in Sungai Raya District, where people are still found selling adulterated liquor. Community members sell mixed liquor freely in the Sungai Raya District, Kubu Raya Regency. For example, one of the shops on Jalan Cempaka Putih, Parit Baru Village, Sungai Raya District, Kubu Raya Regency no longer respects the age limit and openly sells mixed liquor. The type of adulterated liquor that is traded in Sungai Raya District, Kubu Raya Regency is arak mixed with herbal concoctions (cap cuan arak). The actions of members of the public who sell mixed liquor can actually be qualified as a criminal act and the perpetrators can be subject to criminal sanctions in the form of imprisonment and fines, but in fact the sellers of mixed liquor in Sungai Raya District, Kubu Raya Regency have never been enforced by the police. from the Sungai Raya Police, Kubu Raya Regency. So far, sellers of mixed liquor in Sungai Raya District, Kubu Raya Regency have only been arrested with evidence of mixed liquor for 2 or 3 days and then released by the Police. The formulation of the problem in this research is: "Why is there no criminal law enforcement on the sale of adulterated liquor in Sungai Raya District, Kubu Raya Regency?". Meanwhile, the aim of the research is to reveal the factors that cause criminal law enforcement to not be implemented against perpetrators who sell mixed liquor in Sungai Raya District, Kubu Raya Regency by the Police and the countermeasures carried out by Police officers against perpetrators who sell mixed liquor in the District. Sungai Raya, Kubu Raya Regency. The legal research method used by the author is an empirical legal research method with a descriptive research nature.Based on the research results, it was concluded that the number of perpetrators selling mixed liquor in Sungai Raya District, Kubu Raya Regency was 6 (six) people located in several locations. The reason why the police have not implemented criminal law enforcement against perpetrators who sell mixed liquor in Sungai Raya District, Kubu Raya Regency is because the actions of the perpetrators who sell mixed liquor are not as extreme as other crimes and their actions are only violations of Regional Regulations. The countermeasures carried out by the Police against perpetrators who sell mixed liquor in Sungai Raya District, Kubu Raya Regency, are providing legal education to sellers of mixed liquor and community members in the area where mixed liquor is sold in Sungai Raya District, Kubu Raya Regency regarding the dangers. from adulterated liquor and its bad effects. Apart from that, carry out raids at locations where mixed liquor is sold in Sungai Raya District, Kubu Raya Regency and destroy the mixed liquor that is found.  Keywords: Law Enforcement, Crime, Sales, Adulterated Liquor.      ABSTRAK    Salah satu bentuk perbuatan melanggar hukum yang dilakukan oleh warga masyarakat adalah menjual minuman keras oplosan. Hal ini juga terjadi di wilayah Kabupaten Kubu Raya, khususnya di Kecamatan Sungai Raya, dimana masih ditemukan warga masyarakat yang menjual minuman keras oplosan. Warga masyarakat menjual minuman keras oplosan secara bebas di wilayah Kecamatan Sungai Raya Kabupaten Kubu Raya. Contohnya salah satu toko di Jalan Cempaka Putih Desa Parit Baru Kecamatan Sungai Raya Kabupaten Kubu Raya sudah tidak lagi memandang batasan usia dan secara terang-terangan menjual minuman keras oplosan. Jenis minuman keras oplosan yang diperjualbelikan di Kecamatan Sungai Raya Kabupaten Kubu Raya adalah arak yang dicampur dengan ramuan herbal (arak cap cuan). Perbuatan warga masyarakat yang menjual minuman keras oplosan sebenarnya dapat dikualifisir sebagai tindak pidana dan terhadap pelakunya dapat dikenakan sanksi pidana berupa pidana kurungan dan pidana denda, namun faktanya para penjual minuman keras oplosan di Kecamatan Sungai Raya Kabupaten Kubu Raya tidak pernah dilakukan penegakan hukum oleh aparat Kepolisian dari Polsek Sungai Raya Kabupaten Kubu Raya. Selama ini para penjual minuman keras oplosan di Kecamatan Sungai Raya Kabupaten Kubu Raya hanya ditangkap beserta barang bukti minuman keras oplosan selama 2 atau 3 hari kemudian dilepaskan oleh aparat Kepolisian. Rumusan masalah dalam penelitian ini adalah: "Mengapa Penjualan Minuman Keras Oplosan Di Kecamatan Sungai Raya Kabupaten Kubu Raya Tidak Dilakukan Penegakan Hukum   Pidana?". Sedangkan tujuan penelitian adalah untuk mengungkapkan faktor-faktor yang menyebabkan belum dilakukannya penegakan hukum pidana terhadap pelaku yang menjual minuman keras oplosan di Kecamatan Sungai Raya Kabupaten Kubu Raya oleh aparat Kepolisian dan upaya penanggulangan yang dilakukan oleh aparat Kepolisian terhadap pelaku yang menjual minuman keras oplosan di Kecamatan Sungai Raya Kabupaten Kubu Raya. Metode penelitian hukum yang digunakan penulis adalah metode penelitian hukum empiris dengan sifat penelitian deskriptif. Berdasarkan hasil penelitian, maka diperoleh kesimpulan bahwa jumlah pelaku yang menjual minuman keras oplosan di Kecamatan Sungai Raya Kabupaten Kubu Raya sebanyak 6 (enam) orang yang terletak di beberapa lokasi. Faktor penyebab belum dilakukannya penegakan hukum pidana terhadap pelaku yang menjual minuman keras oplosan di Kecamatan Sungai Raya Kabupaten Kubu Raya oleh aparat Kepolisian dikarenakan perbuatan para pelaku yang menjual minuman keras oplosan itu tidak terlalu ekstrim seperti kejahatan lain dan perbuatan mereka hanya pelanggaran Peraturan Daerah saja. Adapun upaya penanggulangan yang dilakukan oleh aparat Kepolisian terhadap pelaku yang menjual minuman keras oplosan di Kecamatan Sungai Raya Kabupaten Kubu Raya adalah memberikan penyuluhan hukum kepada penjual minuman keras oplosan dan warga masyarakat di lingkungan tempat penjualan minuman keras oplosan di Kecamatan Sungai Raya Kabupaten Kubu Raya mengenai bahaya dari minuman keras oplosan dan dampak buruknya. Di samping itu, melakukan razia di lokasi penjualan minuman keras oplosan di Kecamatan Sungai Raya Kabupaten Kubu Raya dan memusnahkan minuman keras oplosan yang ditemukan.  Kata Kunci         :   Penegakan Hukum, Pidana, Penjualan, Minuman Keras, Oplosan.
