<![CDATA[Abstrac Motor vehicle theft is very widespread in Pontianak City, various types of modus operandi are currently being carried out by perpetrators of criminal acts of motor vehicle theft. If this cannot be resolved, this action will certainly be very disturbing to the community. One thing that cannot be denied is that one of the causes of the increasing number of criminal acts of theft of motor vehicles is that, among other things, the crime of holding stolen motor vehicles is increasingly common. So that perpetrators of motor vehicle theft (curanmor) do not find it difficult to market their stolen motor vehicles.The criminal act of detention as regulated in Article 480 of the Criminal Code, where one of the elements of detention that is often proven by the Public Prosecutor in daily trial practice is the element of culpa, which means that if the perpetrator of the detention can be considered worthy, he must be able to suspect the origin of the crime. and it can rarely be proven that the recipient really knows about it (the origin of the goods). In this case, the "intent to gain profit" is an element of all detention.From the data obtained from the Pontianak City Police, in 2013 there were 3 arrests, then in 2014 it increased to 7 cases and in 2015 there were 8 cases so this needs to be studied and reviewed together. Criminology experts have tried to formulate what factors cause crime, but no one can provide absolute limits on the main factors that cause criminal acts. If in looking for the causes of crime, various factors will be found; where a certain factor can give rise to a crime, while other factors give rise to other types of crime. This is what some criminology scholars call multiple factors. The reason why this crime arises is very complex, and within this complex of factors, one factor influences other factors.Starting from the description of the research background above, the problem in this research is as follows: "What are the factors that cause the confiscation (480 KUHP) of two-wheeled motorized vehicles from theft in Pontianak City from a criminological perspective?"That the factors causing the increase in confiscation (480 KUHP) of two-wheeled motorized vehicles from theft in Pontianak City are internal factors, namely economic factors and low legal knowledge factors, then external factors, namely the environment or the person's interaction with the surrounding community.Keywords: Detention, two-wheeled motorized vehicles and theft Abstrak Pencurian kendaraan bermotor sangat marak di Kota Pontianak, berbagai macam modus operandi yang dilakukan oleh pelaku tindak pidana pencurian kendaraan bermotor pada saat ini. Kalau hal ini tidak dapat diatasi tentu perbuatan tersebut sangat meresahkan masyarakat. Suatu hal yang tidak dapat dipungkiri bahwa salah satu penyebab semakin maraknya terjadi tindak pidana pencurian kendaraan bermotor adalah diantaranya semakin marak juga tindak pidana penadahan kendaraan bermotor hasil curian tersebut. Sehingga para pelaku pencurian kendaraan bermotor (curanmor) tidak merasa kesulitan untuk memasarkan kendaraan bermotor hasil curiannya.Tindak pidana penadahan sebagaimana yang diatur di dalam Pasal 480 KUHP, dimana salah satu unsur penadahan yang sering dibuktikan oleh Jaksa Penuntut Umum dalam praktik persidangan sehari-hari adalah unsur culpa, yang berarti bahwa si pelaku penadahan dapat dianggap patut harus dapat menyangka asalnya barang dari kejahatan dan jarang dapat dibuktikan bahwa si penadah tahu benar hal itu (asal-usul barang). Dalam hal ini, "maksud untuk mendapatkan untung" merupakan unsur dari semua penadahan.Dari data yang didapat dari Polresta Pontianak Kota pada tahun 2013 penadahan terjadi 3 kasus kemudian pada tahun 2014 bertambah menjadi 7 kasus dan tahun 2015 terjadi 8 kasus sehingga hal ini perlu dipelajari dan ditelaah bersama. Para pakar kriminologi telah berusaha untuk merumuskan apa yang menjadi faktor penyebab kejahatan, tetapi tidak seorang pun dapat memberikan batasan yang mutlak tentang faktor utama timbulnya tindak pidana. Jika di dalam mencari sebab-sebab timbulnya kejahatan akan dijumpai berbagai macam faktor; dimana suatu faktor tertentu dapat menimbulkan suatu kejahatan, sedangkan faktor lain menimbulkan jenis kejahatan yang lain pula. Hal inilah yang oleh beberapa sarjana kriminologi meyebutnya sebagai multiple factors. Sebab musabab timbulnya kejahatan ini sanagat kompleks, dan di dalam faktor yang kompleks ini, faktor yang satu saling mempengaruhi dengan faktor yang lain.Bertitik tolak dari uraian latar belakang penelitian di atas, maka yang menjadi permasalahan dalam penelitian ini adalah sebagai berikut : "Apakah faktor-faktor penyebab terjadinya penadahan (480 KUHP) kendaraan bermotor roda dua dari hasil pencurian di Kota Pontianak ditinjau dari sudut kriminologi ?"Bahwa faktor-faktor penyebab meningkatnya penadahan (480 KUHP) kendaraan bermotor roda dua dari hasil pencurian di Kota Pontianak yaitu faktor intern yaitu faktor ekonomi dan faktor pengetahuan hukum yang rendah kemudian faktor eksternal yaitu lingkungan atau pergaulan orang tersebut dengan masyarakat sekitarnyaKata Kunci: Penadahan, kendaraan bermotor roda dua dan pencurian]]>
