ABSTRACT Auctions have an important role in selling mortgage objects. Mortgage objects can be auctioned to pay off obligations guaranteed by mortgage rights. In the case position, we will discuss the issue of auctions below the limit on mortgage objects belonging to Katasha Nabila Ratri. Katasha Nabila Ratri, as the debtor, is disputing 2 plots of land that are the object of her mortgage which are registered as objects of collateral. The title of this research is Analysis of the Auction Process Proposed by Creditors for Mortgage Objects Based on Decision Number 427/Pdt.G/2022/PN.Bks, the problem formulation is "How to Analyze the Auction Process Proposed by Creditors for Mortgage Objects Based on Decision Number 427/ Pdt.G/2022/PN.Bks?", the aim of this research is to analyze the auction process proposed by creditors of mortgage rights objects in case number 427/Pdt.G/2022/PN Bks and to analyze the legal consequences for creditors in the decision case number 427/Pdt.G/2022/PN Bks concerning unlawful acts committed by creditors against debtors in carrying out collateral auctions. In this research, the author uses a type of normative juridical legal research which is carried out by examining library materials or secondary data. Based on the analysis of the auction process submitted by the creditor for the mortgage object in case number 427/Pdt.G/2022/PN BKS, the judge has accepted and granted part of the Plaintiff's claim by taking into account the value which reflects the three important principles for the judge in making a decision. The legal consequences of the judge's decision are that Defendant I and Defendant II must pay compensation, Defendant III and Defendant IV must return the land they have purchased, Co-Defendant I and Co-Defendant II must comply with the decision, and the Plaintiff's debt returns to its original position.KEYWORDS: Execution, Auction, Mortgage, Judge's Decision ABSTRAK Lelang memiliki peranan penting dalam menjual objek hak tanggungan, objek hak tanggungan dapat dilelang untuk melunasi kewajiban yang dijamin dengan hak tanggungan. Pada posisi kasus akan dibahas permasalahan lelang dibawah limit pada objek hak tanggungan milik Katasha Nabila Ratri. Katasha Nabila Ratri selaku debitur mempermasalahkan 2 bidang tanah objek hak tanggungan miliknya yang terdaftar sebagai objek jaminan. Adapun judul dari penelitian ini ialah Analisis Proses Lelang Yang Diajukan Kreditur Dari Objek Hak Tanggungan Berdasarkan Putusan Nomor 427/Pdt.G/2022/PN.Bks, rumusan masalah "Bagaimana Analisis Proses Lelang Yang Diajukan Kreditur Dari Objek Hak Tanggungan Berdasarkan Putusan Nomor 427/Pdt.G/2022/PN.Bks?", tujuan penelitian ini adalah untuk menganalisis proses lelang yang diajukan oleh kreditur dari objek hak tanggungan dalam perkara nomor 427/Pdt.G/2022/PN Bks dan untuk menganalisis akibat hukum bagi kreditur dalam putusan perkara nomor 427/Pdt.G/2022/PN Bks tentang perbuatan melawan hukum yang dilakukan oleh kreditur pada debitur dalam melaksanakan lelang jaminan. Dalam penelitian ini, penulis menggunakan jenis penelitian hukum yuridis normatif yang dilakukan dengan cara meneliti bahan-bahan kepustakaan atau data sekunder belaka. Berdasarkan analisis proses lelang yang diajukan kreditur dari objek hak tanggungan perkara nomor 427/Pdt.G/2022/PN BKS bahwa hakim telah menerima dan mengabulkan sebagian gugatan Penggugat dengan memperhatikan nilai yang mencerminkan ketiga asas penting bagi hakim dalam menjatuhkan putusan. Akibat hukum dari putusan hakim adalah Tergugat I dan Tergugat II harus membayar ganti rugi, Tergugat III dan Tergugat IV harus mengembalikan tanah yang telah dibeli, Turut Tergugat I dan Turut Tergugat II harus mematuhi putusan, dan hutang Penggugat kembali pada posisi semula.KATA KUNCI: Eksekusi, Lelang, Hak Tanggungan, Putusan Hakim
