Pre-nuptial agreement is an agreement made before the solemnization of marriage, binding both parties orally and in writing. Pre-nuptial agreements are considered as a preventive measure to address any undesirable possibilities in marriage. This study adopts a qualitative approach with a case study research design. The aim of this study is to analyze pre-nuptial agreements in the context of Maqasid al-Shariah and to understand the practice of pre-nuptial agreements in the community of Kaliwates, Jember. The research findings indicate that aspects of the Maqasid al-Shariah concept include the preservation of religion, life, intellect, progeny, and wealth. As for the community of Kaliwates, Jember, pre-nuptial agreements are predominantly verbal rather than written, where some couples adhere to the agreement while others do not. In the context of Maqasid al-Shariah, pre-nuptial agreements function to safeguard religion, life, intellect, progeny, and wealth.
