Penerapan Asas Praduga Tak Bersalah (Presumption Of Innocence) Pada Sistem Peradilan Pidana Dalam Pemberitaan Di Media Sosial

Tujuan menganalisis realisasi asas praduga tak bersalah pada sistem peradilan pidana terhadap pemberitaan di media sosial, (2) Faktor apa saja yang memengaruhi penerapan asas praduga tak bersalah pada sistem peradilan pidana terhadap pemberitaan di media sosial. Metode yang digunakan dalam penelitian ini adalah penelitian Empiris yang dilakukan di Pengadilan Negeri Makassar dan Polrestabes Makassar. Hasil penelitian : (1) Bahwa asas praduga tak bersalah tidak terealisasi dengan baik karena sadar atau tidak masih banyak dari kalangan pengguna media sosial sama sekali tak menghormati dan tidak memahami esensi dari Asas praduga tak bersalah, sehingga dapat memengaruhi pola pikir dan pandangan pengguna lainya. (2) Bahwa faktor-faktor yang memengaruhi penerapan asas praduga tak bersalah terhadap pemberitaan di Media sosial yaitu faktor individu sendiri, faktor kurang pengetahuan dan pemahaman dari Masyarakat, faktor kemajuan tekhnologi, faktor kurangnya control sosial dan faktor lingkungan. The research objective is to analyze the principle of presumption of innocence in the criminal justice system regarding reporting on social media, (2) What factors influence the application of the principle of presumption of innocence in the criminal justice system regarding reporting on social media. The method used in this research is empirical research conducted at the Makassar District Court and Makassar Police. Research results: (1) That the principle of presumption of innocence is not well realized because whether they realize it or not, there are still many social media users who do not respect and do not understand the essence of the principle of presumption of innocence so that it can influence the mindset and views of other users. (2) That the factors that influence the application of the principle of presumption of innocence in reporting on social media are individual factors, lack of knowledge and understanding of society, technological advances, lack of social control and environmental factors.
