<![CDATA[This study aims to understand and analyze the regulation of acts of same-sex sexual harassment in the perspective of legislation in Indonesia and to analyze the ideal regulation of criminal acts of same-sex sexual harassment in legal reform in Indonesia. This research is a normative legal research. The results of this study are that there are no rules that specifically regulate this act, but it is possible that it can be subject to Article 292 of the Criminal Code, Article 335 of the Criminal Code and Article 6 letter a of Law Number 12 of 2022 concerning Crimes of Sexual Violence. However, these articles still have weaknesses that create legal uncertainty for the victims.Therefore, a clearer and firmer legal policy is needed to regulate acts of same-sex sexual harassment in the future. And law enforcers can also use Article 335 of the Criminal Code as an alternative to solving this problem at this time. The conclusion is that there is no specific regulation governing acts of same-sex sexual harassment and the impact of this act is very large, therefore a legal policy is needed that specifically regulates this act. Abstrak Penelitian ini bertujuan untuk memahami dan menganalisis pengaturan terhadap perbuatan pelecehan seksual sesama jenis dalam perspektif Perundang-Undangan di Indonesia serta menganalisis pengaturan tindak pidana pelecehan seksual sesama jenis yang ideal dalam pembaharuan hukum di Indonesia. Penelitian ini merupakan penelitian hukum normatif. Hasil penelitian ini adalah belum ada aturan yang secara khusus mengatur tentang perbuatan ini, namun dimungkinkan bisa dikenakan Pasal 292 KUHP, Pasal 335 KUHP dan Pasal 6 huruf a Undang-Undang Nomor 12 tahun 2022 tentang Tindak Pidana Kekerasan Seksual. Tetapi dari pasal-pasal tersebut masih terdapat kelemahan sehingga menimbulkan ketidakpastian hukum terhadap para korban. Maka dari itu dibutuhkan suatu kebijakan hukum yang lebih jelas dan tegas mengatur terhadap perbuatan pelecehan seksual sesama jenis dimasa yang akan datang. Dan penegak hukum juga dapat menggunakan Pasal 335 KUHP sebagai alternatif untuk menyelesaikan permasalahan tersebut pada saat ini. Kesimpulannya yaitu bahwa tidak adanya pengaturan secara khusus yang mengatur perbuatan pelecehan seksual sesama jenis dan dampak dari perbuatan ini sangat besar maka dari itu dibutuhkan suatu kebijakan hukum yang mengatur secara khusus terhadap perbuatan tersebut.]]>
