<![CDATA[Economic Crime (TPE) currently still uses criminal law (penal-policy) in its handling, even though legal, criminal means have many shortcomings because they cannot eradicate, criminogens or factors, the occurrence of criminal acts because of their nature which works only after criminal acts have occurred, while dependence on criminal means has made Indonesian correctional institutions overcrowded. Non-penal means are very much needed in overcoming TPE. This research is normative legal research with the data used is secondary data composed of primary legal materials and secondary legal materials which are then analyzed qualitatively and conclusions are drawn using deductive methods. Penal facilities in dealing with crime have caused Indonesian prisons to become overcrowded, which has an impact on the occurrence of other criminal acts and violations of the human rights of inmates. This has proven that the prison system has experienced a shift where the main aim is to rehabilitate criminals so that when they return to society, they no longer commit crimes. Non-penal facilities are very necessary nowadays to tackle crime, especially TPE by changing the community's mindset towards the right direction, through educational means for social change in the right direction. The application of non-penal means is also in line with the theory of criminal treatment which emphasizes aspects of resocialization and improvement for the convict because crimes actually occur outside human will due to factors such as personal character, environment, etc. Keywords: Economic Crimes, Crime in the Economic Sector, non-Penal Policy]]>
