<![CDATA[Makalah ini mengkaji mengenai khuntsa perspektif ulama klasik. Ada beberapa hal yang dapat sebagai solusi dari permasalahan khuntsa, yakni: 1. Khuntsa (orang banci) hendaknya menentukan atau diberi pilihan tentang status hukumnya lelaki atau perempuan, sebab dia yang lebih tahu tentang dirinya itu apakah dekat kepada lelaki atau lebih dekat /wajar ke perempuan. Dalam hal ini dapat meminta bantuan ahli kedokteran (fisik dan kejiwaan dengan tidak melupakan kelamin bagian dalam dan diproses ditetapkan oleh hakim /pengadilan. 2. Penetapan status hukum (identitas) oleh pengadilan tersebut setelah yang bersangkutan melakukan operasi kelamin (perbaikan/ penyempurnaan) dan bukan Taghyir, dan selanjutnya diperintahkan untuk memenuhi hak /kewajiban sebagai lelaki atau perempuan.This paper examined the khuntsa on perspectives of classical muftis. There were several things that could be as a solution of the khuntsa’s problems, namely: 1. Khuntsa (effeminate) should determine or was given a choice about their legal status male or female, because he knew better about himself if he was close to man or closer / reasonable to women. In this case might ask the assistance of medical experts (physical and psychological by not forgetting the inner sex and processed specified by the judge / court. 2.
