Sertipikat sementara terbit tanpa surat ukur, yang saat berlakunya aturan lama fungsi dan kekuatan hukum sertipikat sementara bisa dipersamakan dengan sertipikat. Tujuan penelitian yaitu untuk mengetahui pertimbangan hukum hakim terhadap kedudukan sertipikat sementara dalam putusan No.158/Pdt.G/2020/PN.Mks, Penelitian ini dilakukan di Pengadilan Negeri Makassar. Metode yang digunakan bersifat kualitatif dengan pendekatan yuridis normatif teknik pengumpulan data melalui wawancara yang dianalisis secara kualitatif deskriptif. Hasil penelitian ini menunjukkan bahwa kedudukan sertipikat sementara memiliki kepastian hukum yang lemah dalam fungsinya sebagai alat bukti kepemilikan hak atas tanah. Sertipikat sementara merupakan sertifikat yang lemah dimata hukum yang berlaku saat ini sehingga dalam kasus ini hakim menganggap bahwa kedudukan sertipikat sementara sangat lemah karena tidak adanya surat ukur secara rinci. Temporary certificates are issued without measurement letters, which when the old regulations come into force, the function and legal force of temporary certificates can be equated with certificates. The aim of the research is to determine the judge's legal considerations regarding the position of the temporary certificate in decision No.158/Pdt.G/2020/PN.Mks. This research was conducted at the Makassar District Court. The method used is qualitative with a normative juridical approach, data collection techniques through interviews which are analyzed descriptively qualitatively. The results of this research indicate that the position of a temporary certificate has weak legal certainty in its function as proof of ownership of land rights. The temporary certificate is a weak certificate in the eyes of the current law, so in this case the judge considered that the position of the temporary certificate was very weak because there was no detailed measurement letter.
