DAMPAK KEPUTUSAN KAPOLRI NOMOR:KEP/613/III/2021 TERHADAP TERJADINYA TINDAK PIDANA DI DAERAH HUKUM POLRES BENGKAYANG

ABSTRACTThis study aims to determine and explain the impact of the enactment of National Police Chief Decree Number: Kep/613/III/2021 on the effectiveness of criminal law enforcement and to determine the impact of the enactment of National Police Chief Decree Number: Kep/613/III/2021 on criminal law enforcement in the Bengkayang Police District.   The research location chosen by the author is located at the Bengkayang Resort Police Office. The data collection method used is interviews and questionnaires conducted directly to parties who are considered to know and are directly related to this research problem which are usually called sources or sources of information, namely The sources in this study are as follows: 1).   Head of the Bengkayang Resort Police, Head of the Bengkayang Police Planning Section, Head of the Bengkayang Police Criminal Investigation Unit. Kapolsek and Head of General Section in 6 (six) Polsek only for Harkamtibmas and representatives of community leaders in each Police Sector only for Harkamtibmas. Based on the results of the study, it was found that 6 Polsek were only for Harkamtibmas (not conducting investigations) in the Bengkayang Police jurisdiction consisting of Teriak Police, Lumar Police, Sungai Betung Police, Siding Police, Suti Semarang Police and Capkala Police, the average travel time from Polsek to Polres by motorized vehicle (R2 / R4) was above 1 to 3 hours.   Then, specifically for Capkala Polsek, when it was proposed to become a Polsek only for Harkamtibmas, the police reports amounted to 11 cases.The impact of the enactment of National Police Chief Decree Number: Kep/613/III/2021 on 6 (six) Polsek consisting of Teriak Police, Lumar Police, Sungai Betung Police, Siding Police, Suti Semarang Police and Capkala Police tends to increase, because the Polsek are only given limited authority to receive reports and First Action at the Scene of the Crime (TPTKP), then the investigation process is the authority of the Bengkayang Police Satreskrim. On the other hand, the overflow of criminal cases from 6 (six) Harkamtibmas Polsek adds to the increasing burden of Satreskrim Bengkayang Police. While the number of investigators is still very limited. As a result, criminal cases handled by Satreskrim are not optimal.The efforts made by Bengkayang Police in streamlining investigations after the enactment of National Police Chief Decree Number: Kep/613/III/2021, are as follows: 1) Revising the entire budget for investigation and investigation activities of the Sector Police Only for Harkamtibmas in certain areas. 2). Analyze and evaluate the implementation of activities at the Polsek only for Harkamtibmas every year. 3). Propose to the West Kalimantan Police Chief the change of Polsek only for Harkamtibmas (not conducting investigations) into Polsek that have the authority to investigate.  Keywords: Impact, Law Enforcement Against the Polsek only for Harkamtibmas (Not Conducting Investigation)ABSTRAK  Penelitian ini bertujuan untuk mengetahui dan menjelaskan dampak diberlakukannya   Keputusan Kapolri Nomor: Kep/613/III/2021 terhadap efektivitas penegakan hukum pidana serta untuk mengetahui Dampak Pemberlakukan Keputusan Kapolri Nomor: Kep/613/III/2021 Terhadap Penegakan Hukum Pidana Di Daerah Hukum Polres Bengkayang. Lokasi penelitian yang dipilih oleh penulis adalah bertempat di Kantor Kepolisian Resor Bengkayang. Metode pengumpulan data yang digunakan adalah wawancara maupun kuesioner dilakukan langsung kepada pihak-pihak yang dianggap mengetahui dan berhubungan langsung dengan masalah penelitian ini yang biasa disebut narasumber atau sumber informasi, yaitu Adapun narasumber dalam penelitian ini adalah sebagai berikut: 1).   Kepala Kepolisian Resor Bengkayang, Kepala Bagian Perencanaan Polres Bengkayang, Kepala Satuan Reserse dan Kriminal Polres Bengkayang. Kapolsek dan Kepala Seksi Umum pada 6 (enam) Polsek hanya untuk Harkamtibmas serta perwakilan tokoh masyarakat pada masing-masing Kepolisian Sektor hanya untuk Harkamtibmas. Berdasarkan hasil penelitian ditemukan bahwa 6 Polsek hanya untuk Harkamtibmas (tidak melakukan penyidikan) di daerah hukum Polres Bengkayang yang terdiri dari Polsek Teriak, Polsek Lumar, Polsek Sungai Betung, Polsek Siding, Polsek Suti Semarang dan Polsek Capkala, rata-rata waktu tempuh dari Polsek ke Polres dengan kendaraan bermotor (R2/R4) di atas 1 sampai dengan 3 jam.   Kemudian khusus Polsek Capkala pada saat usulkan menjadi Polsek hanya untuk Harkamtibmas, laporan polisi berjumlah 11 kasus. Dampak diberlakukannya Keputusan Kapolri Nomor: Kep/613/III/2021 terhadap 6 (enam) Polsek yang terdiri dari Polsek Teriak, Polsek Lumar, Polsek Sungai Betung, Polsek Siding, Polsek Suti Semarang dan Polsek Capkala cenderung mengalami peningkatan, karena Polsek hanya diberikan kewenangan terbatas menerima laporan dan Tindakan Pertama Tempat Kejadian Perkara (TPTKP) selanjutnya proses penyidikan merupakan kewenangan Satreskrim Polres Bengkayang. Disisi lain, limpahan kasus pidana dari 6 (enam) Polsek Harkamtibmas menambah beban Satreskrim Polres Bengkayang yang semakin meningkat. Sementara jumlah penyidik masih sangat terbatas. Akibatnya kasus pidana yang ditangani oleh Satreskrim menjadi tidak optimal. Upaya yang dilakukan Polres Bengkayang dalam mengefektifkan penyidikan pasca diberlakukannya Keputusan Kapolri sebagai berikut: 1) Melakukan revisi terhadap seluruh anggaran kegiatan penyelidikan dan penyidikan Kepolisian Sektor Hanya Untuk Harkamtibmas pada daerah tertentu. 2). Melakukan analisa dan evaluasi terhadap pelaksanaan kegiatan di Polsek hanya untuk Harkamtibmas setiap tahunnya. 3).               Mengusulkan kepada Kapolda Kalbar perubahan Polsek hanya untuk Harkamtibmas (tidak melakukan penyidikan) menjadi Polsek yang mempunyai kewenangan dalam penyidikan.  Kata Kunci: Dampak, Penegakan Hukum Terhadap Polsek hanya untuk Harkamtibmas (Tidak Melakukan Penyidikan)
