<![CDATA[Technological advancements have led to the detrimental spread of online gambling promotions through social media. This activity is prohibited under the ITE Law, which provides sufficient criminal penalties to deter potential offenders. This study explores the various criminal offenses associated with online gambling advertisements on social media and examines the factors influencing the legal prosecution of offenders. The research utilizes an empirical approach with analytical and descriptive methods, considering both legal frameworks and real-world circumstances. The findings indicate that promoting online gambling constitutes a punishable offense under the provisions of Article 45, paragraph (1), in conjunction with Article 27, paragraph (2), which prescribe imprisonment and fines for violators.
